Republic of the Philippines PROVINCE OF COMPOSTELA VALLEY ---------------------------------------------------------------------------------------------EXECUTIVE ORDER NO.___ Series of 2019 “AN ORDER CREATING THE TECHNICAL WORKING GROUP FOR THE REVIEW OF THE LOCAL ECONOMIC ENTERPRISE ORDINANCE AND PROPOSE AMENDMENT IN CONSONANCE TO THE MANUAL AS PRESCRIBED BY THE DEPARTMENT OF BUDGET AND MANAGEMENT

WHEREAS, Section 17 of Republic Act No. 7160 known as the Local Government Code of 1991 states among others “…Local Government Units shall likewise exercise such other powers and discharge such other functions and responsibilities as are necessary, appropriate, or incidental to efficient and effective provision of the basic services..”; WHEREAS, the Department of Budget and Management (DBM) created the Manual on the Setting Up and Operation of Local Economic Enterprises 2016, that seeks to address the issue in the proliferation of local economic enterprises that is confronted by inappropriate systems and practices that unfortunately, results into loss. WHEREAS, Local Economic Enterprise (LEE) Manual , is a practical guide to help the LGUs in utilizing Local Economic Enterprise (LEE) to optimize this modality of service delivery. It encapsulates the state policies, rules and regulations affecting LEEs, and provides the detailed procedures for the establishment and operation of LEEs, including their divestment. LEE Manual is intended to provide a step by step guide in establishing and operating LEEs that are revenue generating and self-sustaining. WHEREAS, there is an existing Provincial Economic Enterprise Management Office in the Provincial government of Compostela Valley that is in charge with the operation and management of the four government hospitals, that its formulation is anchored on the LEE Ordinance herein that was created before the issuance of the LEE Manual by the DBM; WHEREAS, with the approval of the Universal Health Care Law, the technical working group intend to integrate the same if doing such would be feasible in this cause. WHEREAS, the objective is to reconcile the differences and to follow the mandate in the LEE Manual by the DBM with the already set system of the LEE Ordinance in the province, thus, to address the situation at hand a committee composed of officers who are capable of crafting the propose amendment and review of the Local Economic Enterprise Ordinance is needed to resolve the sought problem.

NOW, THEREFORE, I, JAYVEE TYRON L. UY, Governor of the Province of Compostela Valley, by virtue of the powers vested in me by law, do hereby execute this order: Section I. There is hereby created a Technical Working Group in charge with the revision and propose amendment of the Local Economic Enterprise Ordinance of the Province of Compostela Valley. Section II. Duties and Functions:

The Technical Working Group: 1. Conduct a feasibility study for the proposed amendment of the LEE Ordinance. 2. Determine the viability of the proposed LEE; 3. Review and assessment of the LEEs shall be done every five years; 4. determine the budget allocation; 5. Ensure the viability of the LEE and to make measures in the instance that the set forth organization and system tend to be not operational; Section IV follows:

Effectivity:
