Aloha Board of Ethics members, This is a request for reconsideration of the BOE conclusions of complaint BOE 06-004. A February 27, 2007 letter from Board of Ethics (BOE 06-004) stated:
I have obtained and read the public session minutes of June 15, 2006 County Council minutes and am unable to find any mention of the following items of specific information which I enumerated in a correspondence received by the Board of Ethics on December 11, 2006.. This letter was in response to a letter requesting “specific information in Mr. Asher's email that was not public information on June 18, 2006” from the Board of Ethics dated November 16, 2006. Here are those items enumerated again below for your convenience:
I found no discussion in the council minutes regarding the actions, opinions, or involvements of myself nor of R. Asher that were first disclosed to me in Asher's unsolicited email. Would the Board of Ethics be so kind as to refer me to the specific page(s), paragraph(s), and sentence(s) upon which the Board of Ethics reached its conclusion that information (disclosed in Asher's mail) that I asserted was not in the public record “had already been discussed at the June 15, 2006 Kaua`i County Council meeting in open session?” It appears the BOE finding of “no violations of the Kaua`i County Charter Section 20.02B ” is unwarranted and not supported by the factual evidence as documented in the public session minutes the BOE asserts contains such facts. Please reconsider this finding or refer me to the specific citations in the public session minutes used as the factual basis for such a finding. Mahalo in advance for your attention to this matter.
