Dear Mayor and Trustees, This letter is to express my complete opposition to AvalonBay proposal to redevelop the the seven acre property and St.Paul’s building. I respectfully request that my statement be part of the public record. I am opposed to any and all development at St. Paul’s by AvalonBay for the following reasons: o I believe the land is public and should remain public parkland. o I believe the financial terms of the deal are not beneficial to the Village of Garden City and to GC residents& taxpayers. o I do not accept the appraisal of NEGATIVE $14.1 Million. I am aware it was performed by Grubb & Ellis, which also has done appraisals for other developments completed by AvalonBay. o I am aware the Village has not performed, or hired an unbiased firm to appraisal the value of the 7 acres property. o I believe that failure to obtain an acceptable appraisal of the property, upon which all other terms of the proposal are based, results in a breach of fiduciary responsibility by the Village and its public officials to obtain the highest and best use of the property. o I believe the fact that the Village has failed to obtain their own, unbiased appraisal of our property, is a breach of ethical and moral responsibility by the Village and its public officials. o I believe there will be a detrimental Impact on Traffic due to increased traffic at the very busy intersection (Stewart Ave. & Rockaway Ave.) at peak time periods. o Please note: I am aware that the Village has not secured, nor does the Village intend to obtain a private, unbiased Traffic Impact Study. o I believe the location is not appropriate, as St. Paul’s is directly opposite our GC Middle School. The safety of the children of our community is at risk. o I am aware that the Front Lawn of the St. Paul’s 7 acre property is used by GC Middle School Programs & Activities- on a regular basis- to navigate across Stewart Ave. and traverse between the GC Middle School and the Fields at St. Paul’s Recreation Complex. No plans or accommodations have been made to address this issue o I believe that failure to consider the use of the property by the MiddleSchool would result in failing to address a significant safety issue, which puts the Village at tremendous risk, o I believe the project is out-of-scale with respect to comparable density developments due to the addition of a 4 story apartment building behind the original main building.

o I believe there will be a significant environmental impact due to loss of green space resulting from AVB parking requirements, the addition of an outdoor pool, patio, 4 story building, and underground parking. o Please note I am aware there has not been an unbiased Environmental Impact Study and no SECQR Study has been performed. o I believe there will be tremendous increase in pollution due to influx of 200+ new residents, combined with the loss of green space. o I believe the there will be a direct and quantifiable impact on our Sanitation Department. o I am aware that rubbish collection and rubbish disposal costs have not been addressed, nor negotiated. o I believe there will be a direct and quantifiable impact on the GC School District. Initially a potential impact of 8 children was studied, however, that number has increase by 4X. o I am aware that AVB recently Significantly INCREASED the Projected Student Impact to 31 STUDENTS. At the 9/17 Estates POA Meeting, Matt Whalen of AVB stated the initial estimates were underestimated and should be readjusted to a more realistic number: 31, by using a .3 factor and multiplying that by the total number of units(108) due to the reknowned GC school district, which was compared to the Glen Cove and Longwood school district. o I am aware that any comparisons to AVB at Glen Cove and Coram are not viable because most units are studios, 1BRs, with few 2BRs and NO 3BRs., and the school districts are not comparable to our GC school district. o I believe there will be a significant environmental impact due to loss of green space resulting from AVB parking requirements, the addition of an outdoor pool, patio, 4 story building, and underground parking. o I believe that AVB proposal, with respect to the agreed upon PILOT Payment Program puts the Village at tremendous risk due to the impact on our School District, Village Services, and Village Infrastructure. o o I believe the “opportunity costs” have not been addressed . o

o I As a taxpayer and resident of Garden City, I believe that granting PILOTS/ IDA exemptions to this multimillion dollar business at the expense of existing residents and businesses is simply wrong! The Garden City School District will certainly be adversely impacted by this deal as well as residents and members of our business community who are paying their fair share of taxes.

Please take into consideration the fact that this is multibillion dollar developer/REIT . When such a company is engaging in a private real estate transaction to develop property, they should retain private funding and NOT look to the IDA for “public assistance”. I formally request that you consider the interests of all impacted when making your decision. I sincerely hope that the desire of one entity does not outweigh the needs, concerns, and financial interests of my entire community, especially the residents, small business owners, and our school system.
