Affidavit Inre Signature Land Case

Affidavit in the matter of Signature Land Development Group, Inc. I, Joseph M. Marcial, Architect (Florida License No. AR 0015565), residing at: 249 Abbeyville Street, Deltona, Florida 32725 Being duly sworn depose and say: 1. That I am a U.S. citizen, born on February 4, 1930, in Newark, New Jersey. 2. That I am 79 years of age, and was commissioned as Architect by the Signature Land Development Group, Inc. on August 2, 2004 to design a Storage Facility Building for a 4.059 Acre site at the Northwest corner of the intersection of Nova Road and Sheri Boulevard in Daytona Beach, Florida. 3. That Drawings were presented to Signature Land Group, Inc. on Wednesday, October 13, 2004, together with an Invoice showing the amount due for architectural services rendered to that date. 4. That the amount due has not been paid and that I was told by Mr. Tom Smith, that Signature Land Group, was selling the land and that the money due me would be paid out of the proceeds of the closing of the sale which was to take place the following Saturday, October 16, 2004. The date of the closing came and went, and the money was not forthcoming. After two weeks of inquiry I was told by Mr. Smith that the new owners of the land would be the ones building the new storage facility, and that they were amenable to using my services as Architect. To date I have heard nothing more about the design of the facility and no effort to defray the amount due me has been made. Further affiant sayeth naught.
