The Legality of Abortion Abortion has been legalized in Canada and the United States by Morgentaler et al. v. Her Majesty the Queen and Roe v. Wade respectively. These rulings state: That “Section 251 of the Criminal Code violates a woman's right to security of person under section 7 of the Canadian Charter of Rights and Freedoms and cannot be saved under section 1 of the Charter,” and, “Texas law making it a crime to assist a woman to get an abortion violated her due process rights”. Abortion poses no threat to a women physical health. Pro-lifers would like people to believe that abortion increases a woman’s risk of breast cancer. However the American Cancer Society, New England Journal of Medicine, Planned Parenthood, the World Health Organization, The American College of Gynaecologists and Obstetricians and many more have stated that this is false.
Also studies have shown that fetuses/embryos do not feel pain before reaching a gestation age of 26 weeks. The Unborn Child Pain Awareness Act, which was a piece of legislature that would have abortionists lie to patients, was been shot down because of lack of evidence to point to fetuses feeling pain. Popular opinion on abortion in Canada and the US closely follows the rulings. With 84% of Canadians believing that abortions should be legal in all or most circumstances (Gallup) and 77% (CBS News/New York Times) or 76% (CBS News Poll

This applies not just to therapeutic abortions as performed in hospitals but also to so-called illegal abortions as done by physician.
