Proposed Agenda for December 10, 2008 Hearing in Case Nos. C 05-02298, C 05-00334, and C 06-00244
Dear Judge Whyte: Pursuant to the Court's Request For Proposed Agendas, dated November 26, 2008, Rambus hereby submits its proposed agenda for the December 10, 2008 hearing. Rambus requests that the following motions be heard at the December 10, 2008 hearing because, for reasons set forth below, Rambus believes that early resolution of these motions may simplify pretrial planning and expedite these proceedings.

Rambus's Motion for Partial Summary Judgment Re Manufacturers' Patent Exhaustion Affirmative Defenses
Rambus believes that early resolution of this motion will simplify pretrial planning and expedite these proceedings because, if granted, it will remove an issue from the case that might otherwise be the subject of unique and fairly extensive evidentiary presentations, including possibly expert testimony. If the Court should deny that motion, then announcing that decision as soon as possible will allow the Court and the parties to address whether this defense should be tried separately, which Rambus believes it would need to be. In any event, early

Rambus's Motion for Summary Judgment on Micron's License Defense and for Partial Summary Judgment on Micron's Lack of Standing Defense
Rambus believes that early resolution ofthis motion will simplify pretrial planning and expedite these proceedings. If the motion is granted, unique evidentiary issues relating to Dr. Farmwald's employment at MIPS will be removed from the case and a number of witnesses who might otherwise be called to testify regarding the issues raised by these defenses will not need to continue to reserve time on their schedules to be available for trial. Just as for the preceding motion, if the Court denies this motion, then an early announcement of that decision will allow the Court and the parties to address promptly whether this defense should be tried separately and how, in any event, the issues can be tried in the most fair and efficient manner. •
Those Portions of Rambus's Daubert Motion No.1 to Exclude Certain Testimony of Joseph McAlexander Relating to References on Which Mr. McAlexander May Rely at Trial (Parts ILB.6 and II.B.7)
Rambus believes that early resolution of Parts II.B.6 and II.B.7 of its Daubert Motion No.1, which address whether Mr. McAlexander may rely on certain late- or inadequately-disclosed references, will simplify pretrial planning and expedite these proceedings. If the motion is resolved in Rambus's favor, the parties can focus their pretrial planning on the references that will actually be addressed at trial and they will not need to spend time on the references that Rambus contends were improperly or inadequately disclosed. If this motion is not decided soon, or if it is decided adverse to Rambus, addressing these references will consume significant pretrial preparation time, including because these references have not been the subject of pretrial discovery. Further, if the motion is not resolved in Rambus's favor, early resolution of this motion allows time for the parties to consider the most effective and efficient manner in which to address these references, including whether they need to ask the Court to permit fact discovery to be reopened. These same considerations argue in favor of early resolution of Rambus's Motion to Strike Portions of the McAlexander Expert Report, which the Court took under submission on October 21,2008.
***** Finally, in addition to the three motions identified above, Rambus respectfully requests that the agenda include a status report by the parties on the identification of a narrowed set of representative parts for trial. At footnote 2 of the November 24,2008 Order on Rambus's motion for summary judgment of infringement, the Court directed the parties to "reach agreement on what parts will be tried to the jury in the January trial, the fewer the better." In accordance with this Order, Rambus made a proposal to the Manufacturers earlier today, and requested a meet-and-confer to discuss the issue this week. Because resolution of the
