RE:

Village of Saugerties Landfill, Ulster County Results of Environmental Sampling Conducted by NYSDEC

Dear Mayor Yerick: The Department of Environmental Conservation has received the contract laboratory analytical results of the environmental sampling that was conducted by the Department on July 2, 2008. During the sampling event, Department staff collected several samples of the iron floc sediments that have accumulated in the wetland directly adjacent to the village landfill, as well as one surface water sample of the runoff from the culvert that runs through the landfill and one groundwater sample from a monitoring well that was previously installed in connection with an adjacent remediation site. The analytical results have been compiled into a short report which is attached to this letter. There were several notable findings in the report. Most notable is that the iron floc samples all contain Arsenic concentrations which are elevated above the background concentration for soils of the Hudson valley region, and one sample contains Arsenic at a concentration which is also elevated above the DEC’s contaminated sediment screening value. Two of the three iron floc samples also contain Manganese at concentrations which exceed the Department’s contaminated sediment screening value. Also notable is that the surface water runoff sample does not contain elevated Arsenic or Manganese which may indicate that the contamination is being removed from water naturally during the formation of the iron flocs. Please review the attached results and contact me within 15 business days to schedule a conference so that we can discuss the next step in addressing the violations that were described in the Notice of Violation letter of May 15, 2008. If you have any questions or comments, please do not hesitate to contact me. Sincerely,

Jeremy A. Giordano Environmental Engineer
