MAJLIS BANDARAYA PULAU PINANG (www.mbpp.gov.my) TENDER 1. Tender adalah dipelawa daripada kontraktor yang berdaftar dengan Lembaga Pembangunan Industri Pembinaan dalam kod bidang/kelas yang berkenaan yang dimiliki sepenuhnya oleh rakyat Malaysia dan masih dibenarkan untuk menyertai tender seperti berikut :PERKARA

TAKLIMAT: ISNIN : Isnin, 18 Februari 2019, Jam 10.30 pagi di Auditorium F Paras 5, KOMTAR, Pulau Pinang. Harga Dokumen: RM50.00 senaskah Tarikh Tutup: Isnin, 11 Mac 2019, Jam: 12.00 tengahari 2.

Kontraktor diwajibkan menghadiri taklimat sebelum membeli dokumen tender. Kontraktor yang tidak menghadiri taklimat atau hadir selepas masa pendaftaran tidak layak mengambil bahagian dalam tender ini.

3.

Syarikat perlu berdaftar dengan Sistem Perolehan Kerajaan Negeri Pulau Pinang melalui laman web ep.penang.gov.my untuk menyertai tender. Dokumen Tender dijual secara 'on-line' melalui laman web tersebut dan perlu dibeli serta dimuat turun (download) melalui akaun Perolehan masing-masing sebagai pengesahan pembelian.

4.

Dokumen meja boleh dilihat di Kaunter Urusetia Tender, Jabatan Khidmat Pengurusan, Tingkat 17, KOMTAR pada waktu pejabat. [9.00 pagi – 4.00 petang].

5.

Dokumen tender yang telah dilengkapkan hendaklah dimasukkan ke dalam Peti Tender yang terletak bersebelahan Kaunter Penerangan, MBPP, Tingkat 3, KOMTAR, Pulau Pinang sebelum jam 12.00 tengahari pada tarikh tutup yang berkenaan. Pertimbangan tidak akan diberi kepada tender yang lewat diterima.

6.

Syarikat yang menyertai tender adalah dibenarkan untuk menyaksikan pembukaan tender pada tarikh dan masa tutup yang ditetapkan. Pengumuman harga hanya akan di baca bagi tender yang bersesuaian sahaja tertakluk kepada kebenaran/justifikasi Jawatankuasa Pembuka tender.

7.

Syarikat yang menyertai tender diwajibkan melengkapkan Surat Akuan Pembida.

8.

Salinan Sijil Perakuan Pendaftaran Kontraktor (PPK) dan Sijil Perolehan Kerja Kerajaan (SPKK) daripada Lembaga Pembangunan Industri Pembinaan (CIDB) hendaklah disertakan bersama dengan dokumen tender.

9.

Majlis tidak terikat untuk menerima tender yang paling terendah harganya atau sebarang tender.

PerihalTender

TENDER MENINGGIKAN ARAS JALAN DAN MEMBAIKI BAHU JALAN DI JALAN LUMBA KUDA DAERAH TIMUR LAUT PULAU PINANG. JK(J)/ST(K)/211/18. Tender ini adalah tertakluk kepada Arahan-arahan Kepada Penender, Syarat-Syarat Am tender dan Spesifikasi Teknikal/Spesifikasi Kerja.

2.

DOKUMEN TENDER

2.1

Tender

hendaklah dibuat di atas Borang-Borang yang telah disediakan dan selepas ini

dipanggil dokumen Tender.

2.2

Dokumen Tender adalah dijual dengan harga RM 50.00 untuk satu set. Hanya dokumen yang dimuat turun melalui Sistem ePerolehan Negeri Pulau Pinang diakui sah dan akan dipertimbangkan.

3.

CARA-CARA MENGISI BORANG TENDER

3.1

Petender hendaklah membaca arahan-arahan dan syarat-syarat dalam dokumen tender serta menyemak kandungan dokumen tender dengan teliti sebelum mengisi Borang-Borang Tender. Petender tidak dibenarkan mengguna Borang yang difotostat. Majlis Bandaraya Pulau Pinang berhak menolak tender yang dibuat atas dokumen yang difotostat.

3.2

Borang tender hendaklah diisi dengan lengkap dan jelas mengikut ruangan-ruangan yang disediakan. Borang-borang tersebut hendaklah seboleh-bolehnya ditaip. Jika ditulis tangan, tulisan hendaklah jelas dan boleh dibaca. 6

3.3

Setiap pembetulan atau pindaan yang dibuat hendaklah ditandatangan ringkas dan dicop dengan cop rasmi syarikat setentang dengan pembetulan atau pindaan tersebut.

3.4

Borang-Borang yang perlu diisi adalah seperti berikut: Borang A,B,D,E,EA, Borang TENDER, Jadual Kadarharga,Surat Akuan Pembida,

Majlis berhak menolak mana-mana TENDER yang tidak mengemukakan maklumat dan dokumen serta Borang yang diperlukan.

4.

PEMBETULAN DAN PINDAAN KESILAPAN

4.1

Semua pembetulan/pindaan ke atas kesilapan-kesilapan yang dibuat terutamanya dalam Borang Tender dan Jadual Hargahendaklah ditandatangan ringkas oleh penama yang menandatangani Dokumen Tender serta dicopkan dengan cop syarikat Penyebut harga. Tandatangan

dibetulkan/dipinda. Pembetulan/pindaan hendaklah dibuat dengan jelas supaya mudah dibaca. 4.2

Majlis berhak menolak Tender yang didapati membuat pindaan tetapi tidak ditandatangani.

4.3

Semua pindaan ke atas Borang Tender selepas dari tarikh tutup Tender tidak akan dilayan oleh Majlis.

5.

PENGHANTARAN DOKUMEN TENDER

5.1

Petender adalah dikehendaki mengembalikan

dokumen Tender yang telah diisi dengan

lengkap dan ditandatangani oleh penama yang diberi kuasa. 5.2

Tender yang telah dilengkapi hendaklah dimasukkan ke dalam Peti Tender yang terletak bersebelahan Kaunter Penerangan M.B.P.P, Tingkat 3, KOMTAR sebelum jam 12.00 tengahari pada tarikh tutup berkenaan. Tender yang lewat diterima tidak akan dipertimbangkan.

5.3

Syarikat yang menyertai Tender adalah dibenarkan untuk menyaksikan pembukaan Tender pada tarikh dan masa tutup Tender yang ditetapkan. Pengumunan harga hanya akan dibaca bagi Tender yang bersesuaian sahaja tertakluk kepada kebenaran / justifikasi Jawatankuasa Pembuka Tender.

6. DOKUMEN MEJA Dokumen Meja boleh dilihat di Kaunter Urusetia Tender, Jabatan Korporat, Majlis Bandaraya Pulau Pinang, Tingkat 17, KOMTAR pada waktu pejabat.

SYARAT-SYARAT AM TENDER

(Nota: SYARAT-SYARAT AM TENDER ini hendaklah dibaca sekali dengan GENERAL CONDITIONS OF CONTRACT dan SPESIFIKASI TEKNIKAL/SPESIFIKASI KERJA) Petender dikehendaki mematuhi sepenuhnya syarat-syarat berikut apabila menyertai tender ini. Kegagalan mematuhi mana-mana syarat di bawah ini membolehkan tender yang dikemukakan oleh petender ditolak.

1.

KELAYAKAN MEMASUKI TENDER Syarikat-syarikat yang hendak memasuki memasuki TENDER MENINGGIKAN ARAS JALAN DAN MEMBAIKI BAHU JALAN DI JALAN LUMBA KUDA DAERAH TIMUR LAUT PULAU PINANG hendaklah berdaftar dengan Lembaga Kemajuan Industri Pembinaan di bawah kod bidang CIDB Gred G2: Pengkhususan CE21.

1.2

Syarikat hendaklah menyertakan bersama dengan Borang-Borang Tender, salinan Sijil Pendaftaran dengan Lembaga Kemajuan Industri Pembinaan di bawah kod bidang CIDB Gred G2: Pengkhususan CE21. Syarikat yang tidak menyertakan salinan Sijil berkenaan adalah tidak layak dipertimbangkan.

1.3

Salinan Sijil Taraf Bumiputera (jika ada) hendaklah disertakan bersama-sama dengan tawaran.

1.4

Pelawaan ini adalah terikat dengan Arahan Kepada Penyebut harga, Syarat-syarat Am Tender dan Spesifikasi Teknikal/Spesifikasi Kerja yang disertakan bersamasama dalam dokumen tender.

1.5

Petender hendaklah mematuhi sepenuhnya syarat-syarat tersebut apabila menyertai tender ini. Kegagalan mematuhi mana-mana syarat akan menyebabkan tender tidak dipertimbangkan dan terus ditolak.

1.6

Tender hendaklah dibuat atas Dokumen asal Tender yang dibeli oleh petender. Tender tidak boleh dibuat atas Borang-Borang salinan. Semua borang-borang berhubung dengan tender hendaklah ditandatangani oleh penama yang diberi kuasa. Mana-mana Borang yang tidak bertandatangan dan tiada cop rasmi Petender tidak layak untuk dipertimbangkan.

2.

BORANG MAKLUMAT LATARBELAKANG SYARIKAT Syarikat hendaklah mengemukakan dokumen-dokumen berikut bersama-sama dengan Borang Maklumat Latarbelakang Syarikat iaitu Borang B.

a

Untuk syarikat persendirian atau perkongsian, satu salinan Borang Pendaftaran Perniagaan A dan B;

b.

Untuk syarikat Sendirian Berhad, satu salinan Memorandum dan Artikel Syarikat.

Sekiranya berlaku sebarang perubahan atau pindaan kepada dokumen tersebut, syarikat adalah dikehendaki untuk memberitahu Majlis secara bertulis.

3.

DATA-DATA KEWANGAN Syarikat hendaklah mengemukakan maklumat dan dokumen berikut yang berkaitan dengan profil dan kedudukan kewangan petender bersama-sama dengan Borang Data- Data Kewangan iaitu Borang C.

a

Salinan Penyata Bulanan Akaun Bank bagi tiga (3) bulan terakhir sebelum tarikh tutup tender untuk meneliti wang dalam tangan.

b.

Salinan Penyata Kewangan yang disahkan dan diaudit oleh Juru audit bertauliah bagi tahun kewangan terakhir. Sekiranya tiada, bagi tahun kewangan setahun sebelumnya.

c.

Laporan kedudukan kewangan petender harga termasuk kemudahan kredit yang disediakan dari Bank/Institusi Kewangan.

4.

REKOD PENGALAMAN Syarikat hendaklah mengemukakan dokumen-dokumen yang berkaitan bersamasama dengan Borang Rekod Pengalaman mengikut format di dalam Borang D.

5.

SENARAI KONTRAK KERJA SEMASA Syarikat hendaklah mengemukakan dokumen-dokumen yang berkaitan bersamasama dengan Borang Senarai Kontrak Kerja Semasa mengikut format di dalam Borang E.

6.

HARGA TAWARAN

6.1

Harga tawaran adalah termasuk semua kos berkaitan yang diterangkan/dinyatakan dalam Jadual Kadar harga, Lukisan Kontrak, syarat-syarat am kontrak, spesifikasi dan arahan-

arahan kepada petender.

Harga-harga yang ditawarkan dalam tender ini adalah tetap dan tidak boleh dipinda selepas tender ini ditutup dan akan berkuatkuasa selama dalam tempoh sah laku tender. Petender yang berjaya ditawarkan tender ini dikehendaki mematuhi syaratsyarat yang ditetapkan sepanjang masa kontrak ini berkuatkuasa dan tidak boleh dibuat sebarang perubahan harga, kecuali ditetapkan sebaliknya.

6.3

Majlis Bandaraya Pulau Pinang berhak menyemak semula jumlah harga tawaran berdasarkan kepada kadar harga yang ditawarkan oleh petender. Sekiranya terdapat apa-apa perbezaan kepada jumlah harga yang ditawarkan dengan maklumat semakan semula oleh Majlis Bandaraya Pulau Pinang, jumlah harga tawaran yang disemak semula oleh Majlis Bandaraya Pulau Pinang akan digunapakai untuk tujuan tender ini.

7.

SPESIFIKASI TEKNIKAL /SPESIFIKASI KERJA Petender adalah dinasihatkan membaca dengan teliti spesifikasi teknikal/spesifikasi kerja yang perlu bagi melaksanakan Tender menyelenggara parit dan bahu jalan serta kerja-kerja berkaitan TENDER MENINGGIKAN ARAS JALAN DAN MEMBAIKI BAHU JALAN DI JALAN LUMBA KUDA DAERAH TIMUR LAUT PULAU PINANG. JK(J)/ST(K)/211/18, supaya tidak timbul masalah kesilapan dalam meletakkan harga.

8.

LAWATAN TAPAK/TAKLIMAT

8.1

Lawatan tapak/Taklimat adalah diwajibkan bagi semua petender yang memasuki tender ini.

Kehadiran petender yang terdiri daripada pemilik syarikat akan

direkodkan.

8.2

Kegagalan pemilik syarikat menghadiri lawatan tapak /taklimat akan menyebabkan syarikat berkenaan tidak berkelayakan untuk dipertimbangkan bagi menyertai sebut harga ini.

8.3

Tarikh lawatan tapak/taklimat ialah pada seperti di iklankan.

8.4

Dokumen tender hanya boleh diperolehi selepas lawatan tapak/taklimat.

8.5

Petender hendaklah melawat tapak projek bagi mengetahui dengan lebih lanjut akan kerja dan tapak bina. Sebarang tuntutan akibat daripada kurang berpengetahuan tentang keadaan kerja dan tapak bina tidak akan dilayan. 11

9.

TEMPOH SAH LAKU TENDER Tempoh sahlaku tender ini adalah selama 180 hari bermula daripada tarikh tender ditutup. Walau bagaimanapun, Majlis berhak untuk melanjutkan tempoh sah laku seb ini apabila diperlukan mengikut peraturan yang ditetapkan.

10.

BON PELAKSANAAN

10.1

Petender yang berjaya, dikehendaki memberi Bon Pelaksanaan di dalam bentuk Wang Tunai atau Jaminan Bank daripada bank-bank yang diluluskan dan berdaftar di Malaysia.

10.2

Syarikat dibenarkan untuk memilih bagi mengemukakan Bon Pelaksanaan dalam bentuk Wang Jaminan Pelaksanaan.

10.3

Nilai Bon Pelaksanaan yang ditetapkan adalah seperti berikut: Bagi jumlah kontrak kerja ini ,kadar bon pelaksanaan ialah 5% daripada nilai kontrak.

10.4

Majlis berhak untuk merampas sebahagian atau keseluruhan Bon Pelaksanaan sekiranya syarikat yang dilantik gagal memenuhi obligasi kontrak .

11.

TEMPOH SAH LAKU BON PELAKSANAAN

Bagi kontrak kerja ini, tempoh sah laku Bon Pelaksanaan ialah dari tarikh kuatkuasa kontrak sehingga dua belas (12) bulan selepas tamat Tempoh Tanggungan Kecacatan.

12.

PELEPASAN BON PELAKSANAAN

Bagi kontrak kerja ini, Bon Pelaksanaan boleh dilepaskan sebanyak 50% sebaik sahaja Sijil Perakuan Siap Kerja dikeluarkan. Baki Bon Pelaksanaan sebanyak 50% adalah dilepaskan atau dipulangkan dua belas (12) bulan selepas tamat Tempoh Tanggungan Kecacatan atau setelah Perakuan Siap Memperbaiki Kecacatan dikeluarkan, mengikut mana-mana yang terkemudian. 13.

TEMPOH TANGGUNGAN KECACATAN

13.1

Bagi kontrak kerja ini, Tempoh Tanggungan Kecacatan (dari tarikh kerja diperakukan siap) adalah selama (12) dua belas bulan.

13.2

Dalam tempoh tanggungan kecacatan ini, kontraktor hendaklah memperbaiki apaapa kecacatan yang berlaku. Jika kontraktor tidak memperbaiki kecacatan dalam tempoh tersebut, Majlis akan menguruskan supaya kecacatan itu dilaksanakan dengan kos yang terlibat akan dituntut daripada tuntutan pembayaran.

14.

KESALAHAN DAN TINDAKAN TATATERTIB

14.1

Sekiranya mana-mana syarikat bersabit dengan kesalahan-kesalahan berikut, maka Majlis berhak untuk mengambil tindakan mengikut syarat-syarat kontrak dan peraturan tatatertib yang sewajarnya. a.

Gagal memenuhi obligasi kontrak

b.

Pemalsuan maklumat/dokumen

c.

Pakatan harga

Sub kontrak secara tidak sah

Gagal mematuhi etika integriti

Kesalahan jenayah

g.

Tanggungan sivil seperti penghutang penghakiman, bankrap dan receivership/liquidator.

14.2

Petender tidak boleh menarik balik tawaran selepas dari tarikh penutupan tender dan sebelum tamat tempoh sah laku sebut harga atau mengenakan had dan syarat tambahan selepas tarikh penutupan tender atau menolak tawaran setelah tender dipertimbangkan atau tawaran dibuat.

14.3

Hukuman-hukuman yang akan dikenakan terhadap syarikat mengikut syarat-syarat kontrak dan peraturan tatatertib yang ditetapkan oleh Majlis, diantaranya adalah seperti berikut:

16.1

Sebarang kegagalan memenuhi obligasi kontrak seperti yang dinyatakan, Syarikat yang dilantik akan dikenakan denda mengikut peruntukan dalam kontrak. Kadar denda yang akan ditetapkan adalah seperti berikut:

Kadar LAD RM200/hari atau Harga kontrak x 22.5% sehari (yang mana lebih tinggi) 365 Majlis akan mengeluarkan notis bertulis kepada syarikat bagi sebarang perbuatan salah laku mengikut syarat-syarat dan spesifikasi kontraktor untuk dikenakan kadar denda yang sewajarnya. Syarikat adalah bertanggungjawab untuk menjelaskan bayaran denda yang dituntut dal tempoh yang ditetapkan.

Jika syarikat gagal membayar denda yang dikenakan, maka tuntutan akan dibuat daripada bayaran yang berhak diterima oleh syarikat. Jika masih tidak dapat dijelaskan bayaran,

maka tuntutan akan dibuat daripada Bon Pelaksanaan.

Seterusnya, diambil tindakan mengikut pentadbiran kontrak.

17.

KONTRAK

17.1

Syarikat yang berjaya adalah dikehendaki mengikat suatu perjanjian bertulis dengan Majlis Bandaraya Pulau Pinang.

17.2

Syarat-syarat dalam tender dan syarat-syarat dalam surat tawaran adalah menjadi sebahagian daripada syarat-syarat kontrak.

18.

TEMPOH KONTRAK

Tempoh kontrak ini adalah selama 6 bulan iaitu bermula dari tarikh yang dinyatakan dalam surat setuju terima.

The works included in the contract are as follows :

Extent of Work.

2.

In the accompanying specification and these Stipulations, Tender and Contract respectively, the following works will be construed to mean and include as follows:

Interpretation Of Terms.

“Contractor” shall mean the person or persons agreeing to execute the works, and shall include the heirs, executors and administrators or permitted assignees of such person or persons. “The Majlis” shall mean the Majlis Bandaraya Pulau Pinang. “Pengarah Kejuruteraan” shall mean the Engineer to the Majlis for the time being, and shall include any other person or persons for the time being appointed by the said Councillors to superintend the said works. “Works” shall include the several works, matters and things comprised or referred to in and by the Specification, Plans, Drawings, Sections and Contract, or intended so to be and to be executed and performed by the Contractor.

3.

The Drawings explanatory of the contract as described in the Specification and believed to be accurate but the contractor must verify them, and must sign them and this specification as an acknowledgement of their sufficiency.

Drawings.

4.

Should any discrepancy appear between the works described in the Specification and those shown upon the drawings, the decision of the Pengarah Kejuruteraan is to be final, binding and conclusive, and all the works which in the opinion of the Pengarah Kejuruteraan may be fairly implied from the drawings and specification, although not specially set forth in either of them are, nevertheless, to be considered as in the contract and to be executed accordingly. Figures where given are to be worked to in preference to Scale Dimensions and detail drawings in preference to General Drawings.

5.

A copy of the drawing and specification will be supplied to the contractor and these must be kept upon the works and be opened for inspection by the Pengarah Kejuruteraan or his representative at any time, and returned to the Pengarah Kejuruteraan upon completion of the works.

Drawings to be kept on Works.

6.

The contractor shall set out the works and shall amend any errors due to inaccuracy at his own cost. The Pengarah Kejuruteraan may, however, furnish levels to which the contractor may work if he thinks fit but the fact of any contractor having worked to such level shall not free him of any responsibility with regard to errors and inaccuracies.

Setting Out.

7.

The contractor is to provide, unless it is specially stated otherwise, the whole of the labour, plant, tools, tackless machinery cartage, scaffolding, centreing, shoring, fencing and materials and workmanship of the best of their several kinds for the carrying out of the contract, and he is to perform in the very best manner the whole of the works as set forth in this specification and shown upon the drawings to their true intent and meaning, and in accordance with the instructions which may from time to time be given by the Pengarah Kejuruteraan.

Materials, Labour tools and plants.

8.

The whole of the works will be under the direction and superintendence of the Pengarah Kejuruteraan for the time being to the Majlis and his decision on all questions relating to the works or to the construction or meaning of the drawings referred to herein and of the Specification, is to be final and binding upon all parties to the contract.

9.

The contractor shall at the request of the Pengarah Kejuruteraan at once dismiss from the works any person employed therein who may in the opinion of the Pengarah Kejuruteraan be incompetent or misconduct himself and should the contractor fail to dismiss such person, the Pengarah Kejuruteraan may dismiss him and have him removed immediately.

Power to dismiss

10.

The Pengarah Kejuruteraan or his representative shall have access to the works at all times, and likewise to any workshops of the contractor or other place where work is being prepared.

Pengarah Kejuruteraan to have access to works.

11.

The Pengarah Kejuruteraan shall have power to order the removal from the works of any materials which in his opinions, are not in accordance with the specification, the substitution of proper executed with any materials or workmanship not in accordance with the drawings and specification; and the contractor shall immediately comply with such order, and should he fail to comply with it within a reasonable time to be stated on the order, the Majlis shall have power to employ other persons to carry out the same, and all expenses incurred thereby shall be deducted from any sums due or to become due to the contractor on account of this or any other contract.

Bad Materials or Workmanship.

12.

(i)

No variation from the drawings and specifications, or in the mode of carrying them out, is to be made by the contractor without an order in writing signed by the Pengarah Kejuruteraan and the contractor shall not be entitled to demand or receive payment in respect of such variation unless he shall have obtained such written order.

Written orders for variations.

(ii)

The contractor shall forward to the Majlis two clear days at least before their Ordinary Meeting in any month an account of his claims (if any) for extra payment for carrying out any such variations of his contract as aforesaid whether for work in progress or completed during the previous month. Such account shall in every case be accompanied by the written order above

mentioned authorising such variations and unless such claims be forwarded in the manner and within the time above limited and accompanied by such written order, same will not be considered and the claims of the contractor against the Majlis in respect thereto shall be deemed to be absolutely extinguished. (iii)

The contractor shall not omit any works provided for in his contract unless under the written directions of the Pengarah Kejuruteraan the value of any work so authorised to be omitted shall be taken into account when the contract is completed and proper deductions made in respect thereof. The amount of such deductions shall be absolutely within the discretion of the Pengarah Kejuruteraan whose decision in that regard shall be final, binding and conclusive.

13.

The Pengarah Kejuruteraan shall be at liberty to vary the dimensions of position of the various parts of the works but the contractor shall be entitled to no extra charge for such alterations provided the total quantity of work be not increased thereby.

Power to vary works.

14.

The Pengarah Kejuruteraan shall have power to order any additional works to be executed, or any of the intended works to be omitted, and such works are to be valued according to the priced schedule which is to accompany the tender for the works and in case any such works be not provided for in the Schedule, the same are to be valued by the Pengarah Kejuruteraan at fair measure and value.

Omissions and Additions

15.

The whole of the materials and plant that may be brought upon the works are immediately to become the property of the Majlis but the contractor shall be at liberty to remove some of them as do not form part of the works herein described upon the completion of the contract, but he shall not remove any of the point or material from the works before the completion of the contract without the consent of the Pengarah Kejuruteraan in writing.

Ownership of Materials.

16.

Any work executed under the contract which in the opinion of the contractor is not included in the lump sum tendered will on the requisition of the contractor be taken note of the Pengarah Kejuruteraan or his authorised agent; and the quantities having been ascertained the question of the allowance of the work and the payment for it will be referred to the Pengarah Kejuruteraan whose decision shall be final, binding and conclusion.

17.

If any work be claimed for as an extra by the contractor and should be measured up under such claim by the Pengarah Kejuruteraan or his authorised agent, such measurement shall in no way be considered as an acknowledgement of the liability on the part of the Majlis or as an admission that the work is an extra.

No liabilities as to measurement of extra work.

18.

All extra works are where practicable to be measured work and not day work.

19.

The contractor is to keep on the works accompetent foreman to super intend the execution of the works, and to receive instructions as the works proceed, such foreman to be considered the representative of the contractor and to be able to converse in the Malay or in the English Language.

(a)

The contractor will be held responsible for all losses accidents damages and failures that may happen in the works while they are under his charge and for all losses, accidents or damages that may occur to the person property of any one in consequence of the execution of these works from whatever cause that may arise he is to hold the Majlis harmless against any action at law that may be taken against the Majlis, in respect of the same and the amount of all losses and expenses incurrred by the Majlis in consequence of any accidents or damages done will be deducted from any moneys that may be due or become due to the contractor or may be recovered from his as the law directs.

(b)

In the case of a contract for or including work on the construction of sewer or excavation or trenching therefore or the construction of a a road carriageway which is to be carried out in a street or place accessible to the public the contractor shall take out at his own expenses an approved Public Liability

Insurance Policy covering accidental injury to any person and accidental damage to property for the period of the contract. Such policy shall be submitted to the Pengarah Kejuruteraan for approval before work is commenced. Compliance by the contractor with his condition will not in any way relieve the contractor of responsibilities and liabilities to the Majlis stated in Clause 20a of these conditions. 21.

The contractor shall commence work within seven (7) days of acceptance of his tender or at such other later date as may be directed in writing by the Pengarah Kejuruteraan and the contract shall be deemed to have commenced and be in force as from such date and the contractor shall carry out the same with proper despatch at whatever point or points as may be directed so as to complete their work within the specified time.

Works commenced and continued.

22.

The works to be completed within calendar month from the date of commencement or as stated in clause 21 except they be delayed, in the opinion of the Pengarah Kejuruteraan by causes outside the control of the contractor in which case he shall grant on application an extension of time in writing but in the event of non completion within such time or such extended time the Pengarah Kejuruteraan shall certify in writing that the works could so have been completed and the contractor shall pay or allow for the Majlis the sum of :

(Whichever higher) as and for liquidated and agreed damages for every day or part of a day beyond such time or such extended time as the case may be during which the works shall remain unfinished such damages to be deducted by the Majlis from any moneys due to the contractor. 23.

The Pengarah Kejuruteraan may be noticed in writing suspend the works during the inclement weather or in the event of a strike taking place amongst the workmen employed in the execution of the said works or from any other excuse that he may find it necessary so to do; the contractor to be allowed such further or additional time of the completion of the contract as in the opinion of the Pengarah Kejuruteraan may be necessary but such extension of time shall not in any way vacate lessen or otherwise effect the validity of this contract.

Suspension of Works.

24.

If the opinion of the Pengarah Kejuruteraan the contractor shall :-

Failure to proceed with diligence.

(a)

Fail to proceed with the work with due diligence.

(b)

Fail to carry out the work or any part thereof in as satisfactory and workmanlike manner.

(c)

Make use of defective materials or materials below specifications.

(d)

Commit any breach of his agreement.

The and in either of any of such cases, the Majlis shall have power to determine his agreement and to enter in and to take possessions of the site and take the work wholly or partly out of the hands of the contractor or employ additional workmen thereon at the expense of the contractor or engage or employ any other contractor or persons or workmen and produce all requisite materials and implements for the due execution and completion of the works and the cost and charges incurred in so doing shall be finally settled by the Engineer’s Certificate and paid for and allowed to the Majlis by the contractor and Majlis may deduct the amount of such costs and charges out of any monies due or to become due from the Majlis to the contractor under this or any other contract.

In case the Majlis shall take the works wholly out of the hand of the contractor the Majlis may give the contractor notice in writing requiring him and his servants to quit the works and if they fail to do so they may be treated as trespassers. A certificate of the Pengarah Kejuruteraan under sub paragraphs (a) (b) and (c) shall be conclusively proofs as between the contractor and the Majlis of the statements contained in it. 25.

The Majlis shall be at liberty to terminate the contract at any time should they find it necessary or advisable to do so even it the contracts has not failed in any of the foregoing particulars specified in Cl. 24 and in this case the Majlis shall pay a fair price of the work actually done and material supplied and make a fair allowance for waste of time and labour incurred by the contractor in connection with the work but shall not pay for respective profits which the contractor might have made had the work proceeded. The amount to be paid to the contractor shall be determined by the Pengarah Kejuruteraan who shall have regard to the schedule of prices included in the contract and whose decision shall be final, binding and conclusive.

Termination of Contract.

26.

The contractor shall uphold the work in good and stable conditions for calendar months after completion and repair any damage which may occur within that time at his own cost unless the Pengarah Kejuruteraan shall decide that he ought to be paid of it which case it shall be treated as an extra; and in case of default to so repair within a reasonable time the Majlis shall have power to employ other persons to do the necessary work and the expenses thereof shall be borned by the contractor and shall be recoverable from him by the Majlis or may be deducted by them from any moneys due to become due to him.

Maintenance.

The stipulation of a maintenance period shall not in any way relieve contractor from the responsibility of making good any defects arising at any time through the use of defective materials or workmanship. 27.

The contractor shall not assign or sub let the whole or any portion of the contract but he shall employ his own workmen to execute the works.

Contract not to be sublet.

28.

In any case in which works of shoring, or other works for the protection or security of buildings are necessary, the contractor shall within a reasonable period before the execution of such works serve notices upon the owners or occupiers of the buildings intended to be shored up or otherwise secured and upon all other parties entitled to notice, apprising them respectively that such works are necessary, that he is about to execute the same and will, at a time to be specified in such notice, enter upon the premises for the purposes of executing such works.

Security and Protection of Adjoining Buildings.

29.

The contractor shall at his cost provide the requisite gatekeepers, watchmen, fencings, hoardings, strutting, shoring bridgeways, lights and all other matters which may be necessary for the due protection and security of the works, and all enclosures for materials or works for the protection of the public and of all buildings and property whatsoever are to or liable to be affected by the works, and shall sufficiently light and watch the same when necessary and shall properly light and watch all the works and shall afford the utmost facility for public and private transit in respect of any roads or rights of traffic which may be inteferred with by the execution of the works; and the fact of the Majlis placing lights and watchmen on the works shall not in any way relieve the contractor from the responsibilities attaining to his under Clause 20 of these conditions.

Fencing, Hoardings, Watchings, Lighting, etc.

30.

The contractor shall return to custody of the Pengarah Kejuruteraan at the time of the delivery up of the works to the Majlis and before he received the instalments payable thereon, all plans, drawings, writings, papers, specifications and documents which may have been delivered to him for his use.

31.

Should the Pengarah Kejuruteraan or other authorised person require it for more perfect satisfaction the contractor shall at any period during the continuance of this contract pull down or unship any part of the said works as the Pengarah Kejuruteraan or other authorised person may direct and which the contractor shall make good again

to his satisfaction. Should the works be found faulty in any defrayed by the contractor, but if otherwise by the Majlis. Any difference arising out of this Clause as to the expenses will be determined by the Pengarah Kejuruteraan. 32.

All fossils, coins, or other articles of value or antiquity which may, be discovered in the course of the works shall be immediately delivered into the custody of the Pengarah Kejuruteraan.

33.

The contractor, from time to time as the works proceed and again at the completion thereof, shall fill up holes and trenches which may have been made or dug level the mounds or heaps of earth that may have been raised or made, and clear away all rubbish other than earth or spoil which may become superfluous or have been occasioned or made in the execution of the works; and the expenses which may be incurred or sustained on account or in consequence of any accident which may happen by means of holes and trenches or connected with the works being dug and left unfenced or otherwise. or materials being left or placed inproper situation.

34.

The contractor will remove all surplus earth and spoil.

35.

Subject to the conditions of the specification the contractor shall be entitled to payment as follows :-

Payment.

An instalment of 80 per cent or the value of such work as in the opinion of the Pengarah Kejuruteraan shall have been satisfactorily executed (to the best of his knowledge) which sum shall be paid within four days of the meeting of Majlis following the date of certificate. After the first payment certificate shall be given monthly if required. On satisfactory completion of the work, contractor shall be entitled to be paid up to 95 per cent, of the value of the work. The balance of 5 per cent shall be paid after expiry of calender months from the date of the Pengarah Kejuruteraan’s Certificate of completion, provided that the Pengarah Kejuruteraan shall certify that the works are then in complete repair and to his satisfaction in every respect. The Pengarah Kejuruteraan shall have the power to refuse to grant a certificate at any time during the contract, if the works are not progressing or being executed to his satisfaction. The certificate if the Pengarah Kejuruteraan shall be a condition precedent to payment.

36.

37.

The Pengarah Kejuruteraan’s certificate shall not relieve the contractor from the obligation to complete the work satisfactorily, nor from any liability which he would otherwise incur in consequence of any default whether discovered during or after the expiry of the period of maintenance. All moneys payable to the Majlis by the contractor under an stipulations herein may be recovered by action of the parties of the time being entitled to sue on this contract, the same may be retained out of any moneys then due or which may hereafter become due from the said Majlis to the contractor under this or any other contract and the Majlis shall have full power to withhold payment of any moneys to the contractor after circumstances shall have arisen which may give rise to such retention as aforesaid until after disposal or settlement of such retention as aforesaid until after disposal or settlement of such circumstances though the sum to be retained may be unascertained at the time. The contractor shall fill in prices in the Schedule of Quantities attached to his tender for the various works embraced in the contract, so that such prices may from the basis of a valuation of any additions to or alterations in the works of this contract. All prices in the schedule must correspond with the prices on which the tender was based.

38.

The contractor must allow in this estimate the sum of Ringgit Malaysia (RM ) for contingencies and the whole or any part thereof not required is to be deducted from the contract amount at the completion of the works as shall be decided by the Pengarah Kejuruteraan.

Contingencies

39.

The contractor must send in his tender upon the from supplied, accompanied by the Schedule of Quantities properly filled in, and the Majlis reserve to themselves the right of acceptance or non-acceptance of any of the tenders submitted.

Form of Tender

40.

Upon the acceptance of this tender the contractor shall enter into a formal Indenture of Contract binding himself, his their, executors and assigns to and with the Majlis for the due fulfillment of this undertaking and shall bear all the costs and charges thereof.

41.

No work whatever will be allowed on Sundays and Public Holidays, unless with the express permision of the Pengarah Kejuruteraan in writing.

Sunday Work

The Pengarah Kejuruteraan shall have power to order the removal and re-execution of any work done in contravention to this section. 42.

The contractor shall carry out the works in such manner as will give a minimum of interference with the traffic and he shall, if ordered by the Pengarah Kejuruteraan carry out such of this operations as the Pengarah Kejuruteraan shall determine, at night time or other times or intervals as required , but no allowances over and above his schedule prices will be paid to the contractor should he be ordered to carry out his work at night time or other times or intervals to be stated by the Pengarah Kejuruteraan during the progress of the work.

Interference with Traffic

43.

No boundary stones shall be moved or in any way disturbed without the consent of the Collector of Land Revenue and the Contractor shall be liable for payment of any fines and cost of refixing such stones moved or disturbed without permission.

(a)

The contractor shall strictly comply with the provisions of any labour ordinance current in force relating to such labour employed by him and the Majlis may deduct from any moneys payable to the contractor all moneys (if any) payable by the Majlis under such Ordinance in respect of labourers employed by or any default by the contractor.

(b)

The contractor shall be responsible for Employees Provident Fund payments for all employees on the work.

(c)

The contractor shall pay rates of wages and observe hours and conditions of labour not less favorable than those established are commonly recognised by employers and trade societies (or in the absence of such established or recognised wages and hours those which in practice are paid and observed by other employers of labour whose general circumstances in the trade or industry in with the contractor is engaged are similar) in the trade or industry in the district where the work is carried out.

(d)

Further the contractor shall recognise the freedom of all his work-people to be members of trade unions and the contractor shall be responsible for the observance of the fair wages clauses by the sub-contractor or sub-contractors. The question of the proper observance of the terms of the fair wages clauses shall be referred to the Commissioner for labour for decision

(e)

The contractor shall cause the last preceding condition to be made known to all his work-people on the premises where work is being executed under contract.

45

(a)

The contractor shall forthwith and as a condition precedent to the commencement of any work under this contract register himself at his own expense with the Social Security Organisation under the Employees’ Social Security Act. 1969 (Act 4) and insure all his employees in the manner provided therefore by the said Act Indemnifying the contractor and the Majlis (including

Employee’s Social Security Act 1969.

for the this purpose every officer and department thereof) from all liabilities arising out of claims by any every workmen employed in the performance of this contract for payment of compensation under or by virtue of the said Act (or any other law prior to, amending or replacing such Act) and from all cost and expenses incidental and consequential thereto. (b)

The Certificate and code Number of Registration of Employers, Original Roll of Employment with Insurance Number of Employees, Contribution Cards and other documents in such form containing such particulars relating to persons employed by him as may be specified therein, under the said Act, or copies thereof, shall be deposited with the Pengarah Kejuruteraan and the Contractor shall maintain if for them in full force and effect by payment of all contributions from time to time on the first day on which the sum ought to be paid and until the completion of this Contract and upon demand the contractor shall produce the last receipt for payment of such contributions.

(c)

If any default is made by the contractor in complying with the terms of any clause the Majlis may (without prejudice to any other remedy available to the Majlis for breach of any terms of this contract):

(1)

Withhold all payments which would otherwise be due to the contractor under this contract and out of such moneys so withheld satisfy and claims for compensation by workmen that would have been borne by the Social Security Organisation had the contractor not made default in maintaining a policy of insurance there under and / or.

(2)

Pay such contributions as have become due and remain unpaid and deduct the amount of such contributions from any moneys due to-become due to the contractor.

(d)

Nothing in this clause shall be constructed to take away or to waive or in any manner to modify the right of the Majlis to be indemnified by the contractor in respect of all compensation, costs and other expenses whatsoever which by reason of the contractor’s default or otherwise become payable by the Majlis under the said Act or other law.

46.

If the contractor shall become bankrupt or shall from any cause whatever be prevented from or delayed in proceeding with any completing the said works according to the terms and conditions of this contract, or shall not proceed in the said works to the satisfaction of the Pengarah Kejuruteraan it shall be lawful for the Pengarah Kejuruteraan to leave or cause to be left at the usual place of abode or business of the said contractor a notice or notices in writing for the said contractor to proceed regularly and effectually with the said works, and in case the said contractor shall for 7 days after such notice is so left as aforesaid make default in regularly and effectually proceeding with the said works, it shall be lawful for the Pengarah Kejuruteraan to employ any other workmen either by contract or measure and value or otherwise in proceed with the said works and complete the same and pay to the said workmen out of the moneys which shall be then due to the contractor on account of this or any other contract the amount of their charges for the same and for all necessary materials to be found and provide for such completion, and all the balance and moneys whatsoever which then afterwards would have become payable or due to the contractor under this contract if this present clause had not been inserted together with all the materials then delivered for the purpose of the works hereby contracted for and then being upon or about the site of the works shall upon such default as aforesaid become the absolute property of the Majlis and the said balance moneys and materials so forfeited and to become the property of the Majlis as aforesaid be insufficient to cover such charges for workmen and materials as are lastly herein before directed to be paid there out then and in such case the contractor shall and will make good and pay such deficiency upon demand.

Bankruptcy and delay

47.

If the said works shall remain uncompleted by the say herein before specified for completion or by the day to which the period of completion may have been extended, all the powers and rights of the Majlis under this contract or the said Specification shall remain and be of full force and effect and may be exercised by the Majlis after the day

STANDARD SPECIFICATION FOR THE CONSTRUCTION OF ROADS, DRAINS AND ANCILLARY WORKS FOR THE ENGINEERING DEPARTMENT CITY COUNCIL OF PENANG ISLAND. I.

GENERAL

1.

General Condition Of Contract The conditions contained in the “General Condition of Contract” for use in connection with constructional work to be done for the City Council of Penang Island under the superintendence of the Pengarah Kejuruteraan shall apply to all works referred to in this Specification except in so far as the said conditions are modified by a Clause or Clauses of this Specification.

2.

Drawing The Drawings referred to in the General Conditions of Contract and this Specifications are those stated in the Addendum to the Specifications together with the Engineering Department Standard Drawings for Roads, kerbings, Drainage and ancillary works and any other drawings which may be issued by the Pengarah Kejuruteraan in the duration of this contract, in modification or amplification thereof. The Contractor shall be deemed to have checked the drawings and he shall advise the Pengarah Kejuruteraan of any errors or omissions and any inconsistencies from the Specifications, Schedule of Prices or General Conditions of Contract.

3.

Setting Out The Contractor shall be responsible for the true and proper setting out of the works and for the correctness of the position, levels, dimensions and alignment of all parts of the works and for the provision of all necessary instruments and labour in connection therewith. If at any time during the progress of the works any error shall appear or arise in this connection the Contractor on being required to do so by the Pengarah Kejuruteraan shall at his own expenses rectify such error to the satisfaction of the Pengarah Kejuruteraan unless such error is based on incorrect data supplied in writing by the Pengarah Kejuruteraan. The Checking of any setting out or of any line or level by the Pengarah Kejuruteraan shall not in any way relieve the contractor of his responsibility for the correctness thereof and the Contractor shall carefully preserve all bench marks, pegs etc. used in setting out the works. The contractor shall arrange for the whole of the works to be set out by a qualified and competent Surveyor and to provide all instruments and attendants required by the Pengarah Kejuruteraan or this representatives for checking the setting out. If the Contractor so requests, the Pengarah Kejuruteraan may in his sole absolute discretion provide lines and levels, depending on the availability of the Department’s surveyors. If such request is granted, no claims for delay on the part of the Department’s surveyors will be entertained. The Contractor or his responsible representative shall be present when setting out is done by the Council’s Surveyors and any delay caused to the surveyor due to absence of the contractor or his responsible representative or due to insufficient or unsuitable materials being available shall be the contractor’s entire responsibility.

4.

Contractor To Examine Site, etc The Contractor shall examine the Drawings, General Conditions of Contract, Bills of Quantities or Schedule of Prices and the Specifications. The levels and dimensions shown on the drawings are believed to be correct but the Contractor shall check these for himself. He shall also inspect the site of works before tendering and, form his opinion of the nature of the ground and allow for pumping, shoring, trench timbering and all other necessary requirements during the course of the work. He shall satisfy himself regarding all matters relating to the proposed works, including any obstacles to excavation or access. No claim will be considered and no allowance made in addition to the tendered rates for want of knowledge of the nature or difficulties of any of the works required to be carried out under the terms of this contract. 25

5.

Contractor To Take All Risks The Contractor shall undertake all risks and liabilities of whatever kind arising out of and incidental to the construction and completion of the works and shall take all necessary steps to protect all adjacent buildings and other works from damage. Any damage caused is to be made good by him at his own expense to the complete satisfaction of the owner and / or the Pengarah Kejuruteraan. All such remedial works shall be carried out without delay so that the inconvenience caused is kept to a minimum. All protective measures shall be kept in position for as long as are considered necessary. The orders by the Pengarah Kejuruteraan for their removal do not relieve the contractor from his responsibilities.

6.

Site Protection The Contractor shall provide all temporary fencing, barriers, watching, lighting and labour which shall be necessary for the protection and safety of the general public and shall take out a 3 rd Party Public Insurance Policy to be approved by the Pengarah Kejuruteraan and to cover all risks under this contract. In addition, he shall provide and display at the direction of the Pengarah Kejuruteraan suitable warning signs when working in or near public thoroughfares. Such signs shall confirm to the standards as set out in the Road Traffic Ordinance, and shall be adequately visible by day or night. The contractor shall also take precautions against flooding from tides and storm water flow when working lowlying areas or in districts subject to inundation.

7.

Damage To Mains, Pipes, Conduits, etc The various services shown in the drawings are approximate and for guidance only. The contractor shall arrange to inform the Departments concerned prior to and when such services are uncovered during excavation. The contractor shall exercise due care and caution to ensure that no damage occurs to any existing sewers, water pipes, electricity, telephone and rediffusion cables, surface drains, bench marks, frames, covers etc. during the work. He shall be held solely responsible for all such damage and shall pay all expenses for repairs. He shall also immediately inform the Pengarah Kejuruteraan of any services encountered which are not shown on the drawings. Should any of the above services be damaged, he shall immediately inform the Pengarah Kejuruteraan as well as the Department concerned so that remedial measures may be taken.

8.

Site Operations As far as is possible, the contractor will be given sole possession of the site. However, the contractor is advised that there may be other contractor working within the area. The contractor will in this case be given joint possession of the site with the other contractors for the purpose of carrying out his contractual obligations and he shall in no way interfere with impede or otherwise prevent the other contractor from carrying out their contractual obligations. The contractor shall allow in his prices for reasonable facilities to the other contractors and for any interference with his work from these other contract operations.

9.

Insurance In additions to the Third Party Public Liability Policy to be taken out under Clause 6 of standard specifications the contractor shall also take out a Workmen’s Compensation Policy for not less than 5 skilled and 10 unskilled Workmen or for such numbers as stated in the Bill of Quantities or Schedule of Prices. The contractor is hereby notified that in addition to or in lieu of Workmen’s Compensation, he may be required to contribute to SOCSO.

10.

Permission To Open Up Road Surface

The contractor shall prior to the commencement of excavation in any street, back lane, pavement or footpath make the necessary application to the Pengarah Kejuruteraan or other appropriate authority and obtain written approval for such work. 11.

Maintenance Of Traffic The contractor will be required to arrange his order of working such that interference to road and pedestrian traffic shall be kept to a minimum. He shall at all times take all precautions and measures as required by the Pengarah Kejuruteraan for the safety and convenience of traffic.

12.

Supervision The contractor shall be responsible for the proper supervision and completion of the work in accordance with the specification and drawings. In this connection he shall employ a competent site supervisor who shall be stationed permanently on site. Instructions issued by the Pengarah Kejuruteraan to this supervisor shall be deemed to have been given to the contractor.

13.

Water Water used on the works shall be from a contractor’s supply connected to the State Water Board’s water main, conforming to and complying with the By-laws and requirements of the Penang Water Authority. The contractor shall provide at his expense an approved fixed cistern of not less than 25 gallon capacity fitted with a ¾” diameter inlet with H.P. ball valve, an accessible stopcock and a ¾” diameter outlet with ¼” or ½” cock all mounted on an approved stand or frame at least 6ft. above ground level and necessary piping for connection to the metered supply. He shall pay for all charges for connection and disconnection and water consumed.

14.

Clearing Site The site of the propose works shall be cleared by removing all vegetation, rubbish, etc. The contractor shall take extra precautions to ensure that existing trees, buildings, etc. adjacent to the works are not damaged during this or subsequent operations. The contractor shall repair or pay at his own expense all damage caused to the trees or buildings by virtue of his negligence in this respect. The site proposed works shall be cleared by demolishing the existing structure between the limits indicated on the drawings. Care shall be taken to ensure that no part of the permanent structure is damaged during such works. The Contractor shall repair at his own expense all damage caused to the permanent works by virtue of his negligence and such repair shall be to the complete satisfaction of the Pengarah Kejuruteraan. Demolition shall be carried down to the level of the foundations. The joint between the existing permanent works and the proposed new works shall be made carefully according to the instructions of the Pengarah Kejuruteraan on site. On completion the joint shall be completely watertight. The Contractor shall remove all debris from the demolished works to dump at a site chosen by the Pengarah Kejuruteraan. The rates quoted by the Contractor shall be deemed to have covered for such removal. On completion of all works, the site shall be left in a clean, tidy condition. All surplus material shall be removed and rubbish cleared. The rates for demolishing shall also include for backfilling where necessary.

15.

Site Office The contractor shall provide a temporary shed for use as an office by the Pengarah Kejuruteraan or his representative with minimum dimension of 10’ 0” x 10’ 8’ 0” high. Permission to erect the temporary shed shall be obtained from the Town Planning and Building Department and Contractor shall arrange to obtain such permission and pay all fees. The office shall be adequately weather-proofed and ventilated. The sole entrance shall be locked, the keys of which shall be given to the Pengarah Kejuruteraan. The office shall be provided with a smooth table at least 3’6” x 27

2’6”, one drawer capable of being locked, 2 chairs and a plan rack. A wash basin with water connected to the State Water Board’s water main supply shall be provided at the option of the Pengarah Kejuruteraan. The position of the shed shall be determined by the Pengarah Kejuruteraan. The whole shed shall be removed by the contractor on completion of the contract. II.

EXCAVATIONS

16.

Excavations In General The contractor shall excavate only to the lines and levels shown in the drawings or fixed on site by the Pengarah Kejuruteraan. Excavations shall be made to the full width required to allow the work to be carried out. The contractor shall submit for the approval of the Pengarah Kejuruteraan his propose methods of excavation. The bottom of all excavations shall be trimmed and levelled in accordance with the drawings and the satisfaction of the Pengarah Kejuruteraan. All pockets of soft material etc. shall be removed and replaced with 1:3:6 concrete where required by the Engineer. The bottom of all excavations shall be pumped dry before any concreting operation is permitted.

17.

Excavation For Drains The contractor shall excavate to the lines and levels shown on the drawings of fixed on site by the Pengarah Kejuruteraan. Excavation shall be made to the full width required to allow the drain side-walls to be built or the pipe to be laid before any concrete foundations are laid. All excavation shall be kept dry by pumping or other means at the Contractor’s expense and if any trench is excavated to below the level required it shall be made up to correct level with concrete at the Contractor’s expense.

18.

Excavation Alongside Building All excavations shall be so supported that they will not disturb the foundations of any adjoining or other building, walls or other structures. Where the Pengarah Kejuruteraan consider it necessary and in all cases where excavation has to be made to a lower level than that of the foundation adjoining or nearby structures the Contractor shall, at his own expense, properly underpin with brickwork in cement mortar, wedge up as required, all such foundation and / or shall shore and strut up the walls, buildings or other structures so as to relieve the load on the foundation during the progress of the works.

19.

Excavation For Roads, Kerbs And Footpaths The contractor shall excavate for the carriageway and footpaths to such widths as shown on the working drawings and to the levels and falls and for the total length shown in the working drawings, including draw-ins, turning spaces, short lengths of connecting roads, etc, all as indicated. He shall thoroughly consolidate the formation to specified falls, excavate, fill in with hard materials and make good any weak places. Excavation for kerbing shall be to the depths, nett widths and levels as shown on the drawings to receive the kerb foundations. The bottom of such excavations shall be well consolidated and any weak places made good in concrete.

20.

Timbering / Steel Sheet Piling Of Excavation The contractor shall provide for all timbering / steel sheet piling and shuttering necessary to hold up the sides of the excavation and prevent collapse. He shall be responsible for the safety of the excavation and shall do everything possible to minimise the risk of such collapse.

Excavation In Pits 28

Measurement of excavation in pits shall be net to the horizontal area of the bottom of the wall or other structures to be built, multiplied by the mean depth, Excavation shall be carried out to the dimensions and depths as indicated in the drawings or as directed by the Pengarah Kejuruteraan The contractor shall provide adequate timbering to hold up the sides and ends of all excavations. Should the sides and ends of any excavations give way, the contractor shall at no extra cost to the employer remove all disturbed ground. Any excavation formed thereby outside the limits shown on the Drawings shall be treated as excess excavation as specified above. When formation level is reached, the Pengarah Kejuruteraan will inspect the exposed ground, and give direction as to what further excavation, if any, he considers necessary. If so directed by the Pengarah Kejuruteraan in writing, such excavations shall be refilled up to formation level with approved fill material or lean concrete 1:4:8 in the manner prescribed by the Pengarah Kejuruteraan. The excavation shall be formed in such manner as to ensure that the work rests on a solid and perfectly clean foundation, or abutts tightly against solid ground. Where the excavation is to be covered subsequently by permanent construction, the contractor shall, immediately after exposing the specified satisfactory foundation, proceed with the construction on that foundation. If the contractor allows any portion of such foundation to deteriorate due to exposure, he shall make good the foundation at no extra cost to the Employer and to the satisfaction of the Pengarah Kejuruteraan Backfilling behind any structure shall be carried out in a systematic manner in layers not exceeding 9” and compacted by mechanical tamper with the structures properly braced or strutted where required of instructed by the Pengarah Kejuruteraan. The Contract rate for pit excavation shall include for the cost of backfilling over break as directed by the Pengarah Kejuruteraan’s representative and all shoring, timbering, gangways, temporary fencing and dewatering. 22.

Pumping The contractor shall be deemed to have inspected the site and form his own opinion as to the amount of water to be met with and, unless otherwise stated, provide at his own expense for all necessary pumping as may be required to keep the excavation dry during the course of work. No claim will be considered due to lack of knowledge of the difficulties and the nature of the ground. Where necessary, heavy duty pumps shall be used to keep the excavation dry and accessible dry and accessible forking working in the early morning. Medium or light-duty pumps shall be provided to cape with the continuous small flow of water that may be present in all cases. If in the opinion pf the Pengarah Kejuruteraan, any of the pumps, hoses or apparatus are not large enough to cope with the work, the contractor shall provide at this own expense such larger or additional pumps etc. as the Pengarah Kejuruteraan may direct. Sumps and wells for the purpose of keeping the work dry shall be sunk clear of any permanent works and shall be refilled when not required. All pumping operations shall generally be carried out with care so as to avoid undermining any part of the work and adjacent properties.

23.

Backfilling And Consolidation No part of the works may be backfilled unless with the consent and knowledge of the Pengarah Kejuruteraan. Suitable excavated material shall be used for filling where required or directed. Any excavated material which is considered by the Pengarah Kejuruteraan as unsuitable for filling shall be regarded as surplus and treated accordingly. Any material containing vegetable organic matter with be rejected. Where there is insufficient suitable material from the excavation to provide filling the contractor shall provide at his own expense suitable red earth or other approved material as may be directed.

Wherever possible, mechanical rammers shall be used to consolidate backfill. For this purpose, the contractor shall provide at least 2 mechanical rammers to be kept on site. Backfill materials shall be kept to within 5% of their optimum moisture content to aid consolidation. Where hand tamping is employed there shall be one person tamping for every person doing the filling. This will be strictly enforced. Filling shall be in 12” layers loose each layer to be well-compacted before the next. No bckfill will be permitted unless the area to be backfilled is dry. 24.

Surplus Soil Any excavation material which is surplus to requirements to the site of the works shall be removed by the contractor. On no account shall surplus soil be deposited on private land adjacent to work unless the contractor can produce written permission of both the owner and occupier of the land.

25.

Rates For Excavation And Backfilling The rates given by the contractor for excavation and backfilling shall be deemed to have covered for all provisions thereof including labour, pumping, shuttering, supply of the red earth, removal of surplus earth, etc.

26.

Excavation In Rock Rock excavation includes the removal of boulders of size greater than ½” cu.yd. and any material which would normally required the use of explosives for its removal. Materials such as tree trunks, shale etc. are not classified as rock. Where rock is encountered, the contractor shall arrange for its removal at the rates quoted in the bill of quantities. Payment will be made only for the actual work done and a careful record of the quantity removed shall be kept by the contractor and the Pengarah Kejuruteraan on site. The rates for rock excavation included its disposal as surplus soil. The use of explosives on the site is not permitted and the contractor shall arrange other means of breaking up rock and removing it from site.

27.

Concrete Foundation Concrete foundation shall either be 1:1.6:3.2 or 1:2:4 or 1:3:6 concrete according to the drawings and shall be to the lines and levels as indicated on the drawing. If necessary, the Pengarah Kejuruteraan shall instruct in writing to have broader widths or greater depths of foundation. These will be measured up as extras.

28.

Hardcore Hardcore shall consist of clean, hard broken bricks, or concrete broken to an average size of 2 ½”. Those shall be well-watered, rammed and thoroughly consolidated to the thickness indicated, finishing off on top to a true and even surface with approved fine granite chippings, stone dust or sand to receive the finishing layer.

III.

CONCRETE

29.

Ready-mixed Concrete Ready-mixed concrete shall comply with the requirements of M.S. 523. The concrete shall be carried in purposemade agitators operating continuously on truck mixers. The concrete shall be compacted and in its final position within 2 hours of the introduction of cement to aggregate and within 45 minutes (or any other period of time as approved by the Pengarah Kejuruteraan if admixture is used) after the addition of water to the cement aggregate mix unless otherwise agreed by the Pengarah Kejuruteraan. The time of such introduction shall be recorded on the Delivery Note together with the weight of the constituents of each mix. When the truck mix is used, water shall be added under supervision either at the site or at the central batching plant as agreed by the Pengarah Kejuruteraan but in no circumstances shall be added in transit. 30

Unless otherwise specified, truck mixer units and their mixing and discharging performances shall comply with B.S 4251. Ready-mixed concrete delivered to the job site shall be accompanied by manufacturer’s certificates stating the details of mix proportions by weight, grade of concrete, type and size of aggregate, date and time of production, type and dosage of chemical admixtures and other relevant production detail in suitable format. In addition, the manufacturer shall supply to the Pengarah Kejuruteraan test certificates for testing of materials, indicating the sources of supplies and other relevant details. 30.

Cement Unless otherwise specified all cement used on the works shall be Ordinary Portland Cement complying with all the requirement of Ordinary Portland Cement as given in B.S.12. Rapid hardening shall only be used with the written permission of the Pengarah Kejuruteraan and if permitted shall comply with the specification for Rapid hardening cement in B.S.12

31.

Transport And Storage Ordinary Portland Cement shall be delivered to site unopened in their original manufacturer’s packing, having the brand and manufacturer’s name market thereon. The contractor shall provide at his own expense a proper and weatherproof store for cement, the floor of which shall be raised 1 1/2' above ground level of the maximum flood level whichever is higher. Aggregate shall be stored on clean hard surface so as to prevent all contamination and admixture with foreign materials. Steel shall be stored so that it is kept clean and reasonably free from rust.

32.

Lumpy Cement Any cement which is hard or lumpy or which has been infuriously affected by any cause whatever shall not be used in the works and shall be removed from site by the Contractor at his expense upon receipt of instructions from the Pengarah Kejuruteraan.

33.

Sand All sand used shall be approved clean sharp pit or river sand free from all earth, clay, dissolved salts or other Impurities. Should the Pengarah Kejuruteraan consider it necessary, it shall be washed and / or screened. It shall pass a 3/16” B.S. sieve and be retained on a B.S 100 Sieve and its grading shall lie within the zones for the fine aggregate as given in B.S. 882 except that zone 4 will not be permitted.

34.

Coarse Aggregate Coarse aggregate for concrete shall be strong, hard, durable, rounded or cubical and free from impurities such as earth, dust or organic matter. Granite, basalt or other igneous rock may be used. River gravel may be approved. The used of the limestone is subject to approval provided its constituents do not have a deleterious effect on the concrete mix. The grading for coarse aggregate shall lie within the zones in B.S. 882. Flaky aggregate (i.e more than 40% elongated stones) will not be permitted. Class “A”:1 ½” coarse aggregate are those passing a 1 ½” B.S. Sieve and retained on a 3/16” B.S. Sieve. Class “B” ¾” coarse aggregate will be taken to mean all stones retained on a 3/16” B.S. Sieve and passing through a 1/4” B.S. Sieve.

Batching As far as practicable batching of concrete shall be by weight. However, where volume bathing is permitted, rigid gauging boxes adding to the exact volume required shall be provided by the contractor. Gouging boxes will not be permitted to be part-filled only.

37.

Sand Bulking Where the sand is damp, allowance shall be made for bulking as the Pengarah Kejuruteraan may direct on site

38.

Mixing Concrete shall be mixed in approved rotary machines each batch not to exceed the rated capacity of the machine. Each batch shall be mixed for a minimum of 2 minutes from the time all the water has been added, until an even consistency is obtained. Each batch shall be fully discharged into a watertight vibration-free platform before succeeding batches may be mixed. The mixer shall be capable of discharging the mix without segregation occurring. The mix shall be so proportional that each batch of concrete mix shall be in its final position before is has commenced in initial set and in no case should this time exceed 20 minutes from the time the mater is added. Partially set concrete shall be rejected and shall not be incorporated in any part of the finished work.

39.

Hand Mixing Where hand mixing is allowed an extra 10% of cement shall be added at the Contractor’s own expense.

40.

Water In Concrete Water used in mixing shall conform to Clause 13 of this specification. The amount of water to be used for each batch shall be decided by the Pengarah Kejuruteraan on site and this amount shall not be varied without his permission. The water shall be put into the mixer in one operation only. Accurate means of gauging water shall be provided by the contractor. The proportion of water in the concrete shall be checked by means of the Slump Test as described in B.S.1881. The maximum slump for vibrated concrete shall be 1 ½ inches. For hand compaction the slump shall not exceed 3 inches.

41.

Transport And Placing Of Concrete Concrete shall be transported from the mixer to its final position in such manner that no segregation of the mix occurs. Concrete shall be placed in shallow, even layers and compacted. No slopes where the aggregate can separate will be allowed. 32

42.

Consolidation Of Concrete Consolidation of structural concrete will be by mechanical vibrators only. Such vibrators shall only be handle by skilled an competent operators who shall not allow over-vibration to segregate the concrete. At least one spare vibrator shall be kept on site against the possibility of a breakdown. Where concrete is consolidated by hand, the Contractor shall provide sufficient men to ensure an efficient job. Proper tamping rods shall be provided to those men.

43.

Curing All fresh concrete shall be properly cured for a minimum period of 7 days. Sacking if used must be kept continuously wet through this period.

44.

Minimum Crushing Strength The crushing strength of a 6” cube made according to B.S 1881, Method of Testing concrete shall be as follows:-

NOMINAL MIX

The contractor shall provide sufficient steel moulds to make a minimum of 6 test cubes per concreting session. The cubes shall be made, store and tested in strict accordance with the previously mentioned British Standard all at the contractor’s expense. Should the works cube of any section of the works fail to reach the minimum strength required, the contractor shall at his own expense cut and remake such section to the complete satisfaction of the Pengarah Kejuruteraan or else make such additions of alteration as the Pengarah Kejuruteraan may choose, again at his own expense. Testing of the cubes shall be made by the Engineering Department at the Stores in Brick Kiln Road and the contactor shall transport all cubes as required for testing to that place. The cost of testing successful cubes shall be borne by the Contractor. 45.

Formwork And Shuttering Formwork for concrete shall be of sound timber, planed smooth where necessary and fixed rigidly so as to confine the wet concrete and hold it firmly to the shapes, sizes and positions shown in the drawings. The formwork shall be of sufficient size and strength to withstand the loads imposed by the wet concrete and vibration without movement, bulging, sagging etc. All shuttering shall have tongued and grooved edges to prevent leakage and shall be at least 1” thick. The face in contact with the concrete shall be planned smooth. If plywood facing is used, the shuttering need not be tongued and grooved but sufficient braces shall be used to ensure rigidity. Old shuttering where used shall be cleaned of all old concrete mortar etc. Mould oil from an approved source shall be applied to the inside faces of all shuttering. Shuttering which has deteriorated in any way through constant use shall be rejected. All timber used shall be sound timber and well-seasoned. Timber which has warped, shrunk or twisted or in any way unsuitable shall be rejected. No concrete shall be poured until the formwork has been approved by the Metal ties, if used, shall be so arranged that on completion, no metal projects to within 2” of the concrete surfaces. 33

46.

Stripping of Shuttering No shuttering is to be stripped without the prior approval and knowledge of the Pengarah Kejuruteraan. Stripping of shuttering shall only be carried out in the presence of the Pengarah Kejuruteraan. The shuttering shall be removed carefully so as not to injure the fresh concrete. Formwork shall be so arranged that this is possible. On removal of the shuttering the concrete surface shall be left intact for the inspection of the Pengarah Kejuruteraan. No remedial measures of any sort shall be taken until ordered by the Pengarah Kejuruteraan.

47.

Rates For Formwork Formwork is measured as the net area in contact with the finished concrete surface and no allowance is made for temporary construction, day-work, joints, waste, etc. The rates for formwork are inclusive of all bolts, wedges, clamps, struts, props, labour, etc., required to manufacture, erect and remove such formwork to enable the construction of the structure as shown in the drawings.

48.

Spacer Blocks for Reinforcement Cover 1:2 cement mortar blocks shall be made such that the exact cover as specified is obtained. These blocks shall be cast with soft drawn galvanized wire so that they may be tied rigidly to the reinforcement. Enough spacer blocks shall be provided to ensure that the cover at any portion of the works is that specified. Stones or wooden blocks will not be permitted.

49.

Concrete Surface The concrete surface on removal of the forms shall be smooth and shall show no flashing or honeycombs. Flashing shall be removed by mechanical rubbing down with carbarundum stone or similar abrasive until the surface is smooth. Honeycombs shall be repaired by hacking out the whole defective area ss indicated by the Pengarah Kejuruteraan is expose sound concrete. Concrete of the same mix or 1:3 cement mortar (as directed by the Engineer) shall then be bonded to the sound concrete and the whole surface shall be rubbed down with carborundum stone until smooth. The contractor’s attention is drawn to the fact that all structural concrete shall be left unplastered. Therefore a smooth finish is essential, and the contractor shall take all necessary precautions to obtain such a finish. Where the finish, in the opinion of the Pengarah Kejuruteraan, is below the standard expected, the contractor shall, at his own expense plaster the whole structure with ½” thick 1:3 cement mortar to obtain a smooth finish.

50.

Clear Rubbish Etc. Before Concreting Before concreting can commence all loose rubbish, stones, sawdust, etc. shall be removed from the insides of the forms either with a jet of compressed air or flushing with clean water. A hole shall be left at the base of the shuttering for such operations. This hold shall be closed up prior to concreting. A layer of 1:3 cement mortar shall precede the fresh concrete.

51.

Concreting Without Prior Approval No concreting shall be permitted without the prior approval of the Pengarah Kejuruteraan. The contractor shall cut out at his own expense those portions where prior approval has not been granted, upon receiving instructions from the Pengarah Kejuruteraan. The contractor shall give a minimum 24 hours notice of his intention to concrete so as to facilitate checking by the Engineer.

52.

Concreting In Water Concreting shall as far as practicable be carried out in the dry. Concreting under still water will only be permitted in the presence of the Pengarah Kejuruteraan. Under no circumstances will concreting in running water be allowed. 34

53.

Inclement Weather No concreting will be permitted during periods of inclement weather and the contractor shall take steps to prevent damage to the works during such periods.

54.

Construction Joints Construction joints of approved pattern shall be constructed if concreting cannot be finished in one operation. Work shall only be between such joints. Under no circumstances will concrete be allowed to terminate in a slope at the end of the day’s work. The position of construction joints shall be decided by the Pengarah Kejuruteraan. No other such joints will be permitted. Before commencing the next section, the joint shall be hacked to remove all laitance and expose sound concrete. As an alternative, the concrete when green can be thoroughly wire brushed. All loose material shall be removed (preferably with a jet of compressed air) and a layer of 1:3 cement mortar shall precede the fresh concrete

55.

Expansion Joints Expansion joints as detailed in the drawings shall be provided. Where waterstops are indiccated, rush waterstops shall be of approved pattern and construction. The waterstops shall be securely fixed to the forms in the position as indicated on the drawings. It is to be strictly noted that no nails, screws, etc., shall be used for this purpose. Waterstops shall be supplied in a single piece only. No joints or laps will be permitted. During concreting care shall be taken to ensure that the concrete around the water stop is well compacted. On completion the water stop shall be capable of retaining the liquids without leakage.

56.

Steel Reinforcement Steel reinforcement shall be of best quality steel and conform to the requirements of B.S. 785 “Rolled steel bars the hard-drawn wire for concrete reinforcement” and B.S. 1221 – “Steel Fabric for concrete reinforcement” which ever is applicable. The contractor shall produce certificates from a competent authority stating that the steel to be used does in fact comply with the requirements.

57.

Cleaning Reinforcement All steel reinforcement to be embedded in concrete shall be thoroughly cleaned of all loose rust, millscale, dust, oil, dirt, dried morter etc. before concreting is permitted. A stiff wire brush shall be used for this purpose. Steel reinforcements which has become excessively rusted or in any way deteriorated due to prolonged exposure shall be condemned and shall be removed from site by the contractor at his own expense when so required by the Pengarah Kejuruteraan.

58.

Bending Reinforcement Reinforcement bars shall be bent by machine or other approved means producing a gradual and even motion. All bars shall be bent cold unless otherwise directed by the Pengarah Kejuruteraan. Bars bent hot shall not be heated beyond a cherry-rod colour and after bending shall be allowed to cool slowly without quenching. Bars dependent on cold-working for their strength shall always be bent cold. Bars shall not be welded unless the written consent of the Pengarah Kejuruteraan has been previously obtained. Only electric arc welding will be approved. All bending dimensions shall conform to B.S. 1078 “Bending Dimensions of Bars for concrete reinforcement” in general and to the dimensions and shapes given in the bar bending schedule. 35

59.

Fixing Reinforcement Reinforcement shall be accurately and securely fixed and maintained in the position described on the drawings or as instructed by the Engineer on site. Bars shall be tied together with No.16 gauge annealed soft-iron wire. Where required steel distance pieces shall be tied to reinforcement to ensure correct separation between 2 layers. All cover to reinforcement shall be as specified in the drawings and shall be accurately maintained by mortar blocks to within 1/8” tolerance. Where necessary, steel reinforcement shall be well-supported to ensure that it maintains its correct position during concreting and vibration. No concreting will be allowed until all reinforcement, cover etc., has been approved by the Pengarah Kejuruteraan.

60.

Concrete Admixtures No concrete admixtures shall be used without the prior knowledge and approval of the Pengarah Kejuruteraan. Where concrete admixtures are permitted, their used shall be strictly in accordance with their manufacturers’ recommendations, and with the full approval of the Pengarah Kejuruteraan. The contractor shall submit to the Pengarah Kejuruteraan for his prior approval the trade name of any proposed admixture, manufacturer, together with all salient details of the proposed admixture. The use of any admixture by the contractor shall not be counted as extra above the rates for concrete unless its use has been expressly ordered by the Pengarah Kejuruteraan in writing.

IV.

DRAINS AND CULVERTS

61.

Types Of Drains And Culverts Drains and culverts shall be of several types as shown on the drawings, viz: -

62.

(i)

Standard section drains consisting of a precast channel invert laid on concrete foundations and with castin-situ side-walls sloping slightly outwards. Such drains may be open or covered by slabs to take pedestrians.

(ii)

Pipe drains, consisting of spun concrete pipes, on a concrete foundation and, in certain circumstances; haunched or surrounded in concrete. Scupper drains and certain drains under roads, back lanes and entrances come in this category.

(iii)

Culverts consisting of a standard section open drain bridged by precast reinforced concrete slabs supported on independent abutments constructed outside the drain sidewalls.

(iv)

Open drains similar to (i) but without side-walls.

(v)

Specially designed drains and culverts as fully detailed on the drawings.

Standard Section Drains “1:2:4 concrete (Aggregate Class “B”) to form a bed for the channel inverts shall be carefully placed, not tipped into the trench, and shall be rammed to an even surface. The channel inverts shall be bedded thereon in cement mortar, boned and laid to even and regular falls and all joints shall be carefully pointed as laying proceeds. The sidewalls shall be carried up in “1:2:4” concrete (Aggregate Class “B), laid and consolidated as last, all in accordance with the detailed cross-sections.

Construction joints as necessary and permitted shall be as shown in the standard detail drawing. The sidewalls shall be laid in lengths of about 30 feet with a gap between every two lengths. This gap shall be filled not less than 48 hours after the main length has been laid. The contractor shall allow for providing all timber centering in 10 ft. lengths for each sized section of drain. Care must be taken that the cross-bracing to the shuttering is of such a length as to allow for the ½” cement mortar rendering to both sides of the drain. The shuttering shall be struck after 48 hours or on the instruction of the Pengarah Kejuruteraan; if Rapid Hardening Portland cement is used the shuttering may be struck after 24 hours. The inverts shall be formed of precast channel inverts of sizes shown in the drawings. Precast inverts shall be manufactured in concrete of one volume of cement, one volume of sand and two volumes of ½” – ¼” granite chippings in proper moulds to the shape and size shown in detail drawings, all to the approval of the Pengarah Kejuruteraan. Such inverts shall be cured for 21 days before use. 63.

Weep-holes Weep-holes, 4” square, shall be formed in both sidewalls of the drain 20 ft. apart and immediately above the invert and rendered internally as for sidewalls. Dry stone lining shall be placed at the back of each weep-hole to lead the water to the drain.

64.

Existing Drains The contractor shall make good the junctions with all existing drains and finish the same with ½” cement mortar in a proper manner, forming the channels through the sides of main drain with a neat curve in the direction of the flow. No quick falls will be allowed and connections shall be curved or sloped down to the main drain. He shall, make similar connection to all latrines or house drains abutting on this drain and also where the new drain connects to any existing road drain making good all work disturbed. Where the latrine floor is above the level of the coping of the drain, the contractor shall form proper cement aprons, as directed, for the full width of the latrine pail door.

65.

Entrance Bridges Entrance bridges for foot traffic shall be constructed to the backlanes and properties abutting on the lines of drains wherever there is an existing gateway or entrance, and of such a width as is necessary for the gates and entrances with a maximum width of 4’6” but in no case less than 2 ft. Reinforced concrete slabs of suitable approved thickness in accordance with the width of drain may be used bedded in cement mortar on the drain walls. Entrance bridges for vehicular traffic shall be constructed in accordance with the standard detail drawing thereof in removable precast reinforced concrete slabs on independent abutments in the manner specified below under “Culverts”.

66.

Pipe Drains (including scupper drains) Pipe drains shall be of spun concrete pipes laid on a bed of “1:3:6” concrete (aggregate class “A”) 3” thick for scupper drains, 6” thick for all other drains. The foundation shall be laid to correct line and gradients and shall be 12” wider than the outside diameter of the pipe. The pipes shall be laid butted against one another, the joints caulked with cement bag paper and a 3” wide by 1” to 1 ½” thick collar of “1:2:4” concrete (3/8” aggregate) placed around the joint. All pipes shall be haunched or surrounded with “1:2:4” concrete (Aggregate Class “B”) as shown on the drawings or directed by the Pengarah Kejuruteraan.

67.

Culverts Culverts shall be constructed in accordance with the drawings and standard detail plans. “1:3:6” concrete (Aggregate Class “A”) foundations at the same depth as the drain foundation shall support abutments of brick or “1:2:4” concrete (Aggregate Class “B”) as may be detailed. The abutments shall be clear of the drain side-walls, 37

the space between being filled with earth, and of such a height that there is a clearance of at least 1” between the coping of the drain side-wall (which may be cut down) and the underside of the slab. The slabs shall be of reinforced concrete as shown on the drawings and shall be precast in sections not more than two feet wide (the actual width will be less for longer spans), and laid on the abutment walls. The slabs shall be in “1:2:4” concrete (Aggregate Class “B”) and shall be cast for at least 21 days before placing in position. Where shown on the drawings guardwalls in rendered brickwork or 1:2:4 concrete (Aggregate Class “B”) as detailed shall be constructed being supported on the end slab of the culvert. V.

BRICKWORK

68.

Brickwork All bricks shall be clay bricks, well-burnt to an even colour throughout. They shall be sound, hard and square, and even in size. Bricks which do not in the opinion of the Pengarah Kejuruteraan, come up to the required standard shall be rejected and the contractor shall cause their immediate withdrawal from site-they shall be replaced by bricks which meet the approval of the Pengarah Kejuruteraan. Unless otherwise stated all brickwork shall be laid in English Bond. All bricks shall be soaked in water 24 hours before their use and all brickwork shall be reinforced with a layer of “EXMET” at every fourth course. All joints shall be flush and all excess mortar shall be struck off. No joints shall exceed ¼ inch in thickness. Brickwork of manholes, abutments, guard walls, etc. shall be in English bond but for 4 ½” wall shall be in stretcher Bond to the dimensions shown on the drawings, built true to line and level. All bricks shall be thoroughly wetted by soaking in clean water before laying and all joints shall be filled up solid with cement mortar as the work proceeds and joints shall be raked out to provide keg for rendering where specified or finished with well flushed joints if not to be rendered. No four courses of brickwork shall gauge in height 1 ½” more than the total thickness of the bricks themselves laid dry and it shall be carried up in stages not higher than three (3) feet.

69.

Cement Mortar Cement Mortar shall be in the proportion of 1 part cement to 3 parts sand mixed with just sufficient water to form a thick paste. Mixing shall be thorough whether by machine or hand and the mortar shall show an even colour and consistency throughout.

70.

Rendering All plaster shall be 1:3 cement mortar ¾ thick unless otherwise indicated. Faces of all new brickwork to receive plaster shall be clean and thoroughly wetted to ensure proper bond. The surface of the plaster shall stand a straight edge in any direction. All plaster which is defective in any way shall be cut out under the Pengarah Kejuruteraan’s direction. All edges where the new plaster is to bond to the old shall be under cut. In general, all new plasterwork shall match the existing such that no unsightly arises or lines are formed. All rendering shall be done in 2 courses with the first course well-roughtened to bond to the second.

71.

Bakau Piling If bakau poles for piles or rollers are required these shall be at least 15” in circumference at the small end, straight, sound, hard free from shakes or flaws and supplied on site with the bark intact as far as practi-cable. Any price for piling shall include driving, which shall be carried out with a tight fitting metal ring at the head to prevent damage to the pile head and in the presence of the overseer in charge of the works. Any split or damaged piles will be replaced as directed at the expense of the Contractor 38

VI.

KERBING, FOOTPATHS AND SIDETABLES

72.

Kerbs The kerbs shall be precast “1:2:4” concrete (Aggregate Class “B”) conforming to the lengths, dimensions and shapes shown in the working drawings or the standard detail drawing for straight and radius kerbs amd L-shaped kerbs. The moulds shall be strongly constructed to withstand warping and the kerbs shall be cast face downward well tamped or vibrated and shall be properly cured and protected from direct sunlight for 14 days, and shall be kept watered during this period and up to 21 days before use and must at that age be able to withstand loading tests similar to those given in B.S.340:1950 to the satisfaction of the Pengarah Kejuruteraan. Kerbs may be supplied by the Council at the prices fixed by the Pengarah Kejuruteraan.

73.

Kerb Laying The contractor shall include in his price for providing the kerbing, excavation, concrete bed, laying true to line and level, work laid straight, to sweep or to radius, and concrete hauching, all in accordance with the standard drawing for kerbs and the working drawings. He shall excavate in any material and dispose of the excavated material as specified. The excavation shall be of sufficient width and depth for a bed of “1:3:6” concrete (Aggregate Class “A”), 4 inches in thickness at the face of the kerb and 6 inches thickness at the face of the back of the bed, and 16 inches in width to allow for 5 inches in front of the face of the kerb and 6 inches behind the back of the kerb. “1:2:4” concrete (Aggregate Class “B”) shall be extended up the back of the kerb to the dimensions shown in the standard detail drawing after the kerb has been laid. The kerbs shall be laid true to line and boned to level on a bed of cement mortar with ½” butt joints and the top surface shall have the same cross-fall as the footpath. The ends of the kerbs shall be covered with cement mortar before placing and setting and the butt joints shall be nearly struck. After the kerbs are laid and jointed to the Engineer’s satisfaction a concrete channel 5 inches wide shall be formed in front of the kerb in surface. The concrete shall be to the correct edge-of-road levels and shall be graded and shaped to the scuppers as shown on the standard detail drawing. The channel shall be formed and cured before the road foundation is laid.

74.

Kerbing At Vehicular Entrances At any point at which vehicular entrances are permitted from the carriageway, the kerb shall be laid in the following manner :For a length of not less than 4 kerb lengths opposite the entrance, the kerb shall be laid flat on a foundation of “1:3:6” concrete 19 inches wide and not less than 7 ½” thick and at such a level that the face of the kerb is not more than 1 ½ inches and not less than 1 inch above the level of the edge of the carriageway. The kerb on each side of this lower level kerbing shall be laid as stated in Clause 71 above but shall slope longitudinally from the normal kerb height down to the lower level as shown in the standard detail drawing.

75.

Footpaths The footpath shall be laid out to the dimensions shown on the drawings and the Contractor shall allow in his price for any excavation or hard filling necessary to produce the required level, cross and longitudinal falls and shall properly consolidate the base to receive a 1 ½” finished thickness after rolling of Cold Fine Asphalt which will be supplied by the Council at rates fixed by the Pengarah Kejuruteraan. At vehicular entrances there shall be 3” to 4” thickness of consolidated hardcore under the asphalt.

76.

Concrete Pavements Concrete pavements shall be formed and laid out similar to footpaths, but the finished surface shall be laid out in 2” precast concrete slabs as specified, not less than 2 feet square, on a layer of sand with evenly staggered butt joints; or if so directed constructed in situ of 1:2:4 concrete (Aggregate Class “B”) 4” thick with wooden trowelled surface finish and before hardening marked out with staggered slab joints to simulate precast slabs or formed with roughcast non-slip surface finish as directed.

77.

Grass Sidetables The contractor shall level that portion of the sidetables not paved as a footpath to the levels and falls indicated on the drawing allowing in his price for carting surplus earth from site. Turfing shall be provided after the Contractor has made up the sidetable to the correct level, the top 3 inches to be finished in fine soil to receive suitable turf. At vehicular entrances the sidetable shall be made up as in Clause 74.

VII.

CARRIAGEWAYS

78.

Formation The formation of the carriageway shall be trimmed to correct levels, gradients and camber and shall be well consolidated, with a road roller if directed, before the foundation is laid.

79.

Camber The average camber or cross-fall of the finished road surface shall not exceed 1 in 36 and the surface shall be slightly rounded for a width of four feet on the crown. At bends super-elevation of the carriageway shall be provided as directed.

80.

Foundation The foundation shall be crusher run granite consisting of two layers of best quality unweathered angular granite blocks to the satisfaction of the Pengarah Kejuruteraan. The consolidated thickness of each layer shall be between 3 ½ and 4 ½ inches. Each layer of crusher run stone shall be blinded with a mixture of one part good quality red earth, quarry overburden or laterite and three parts granite dust, and watered and rolled until a hard homogeneous surface is formed. Excess blinding material shall then be brushed off to expose the stone on the top layer. The size of the crusher run shall be 4 inches and downwards. The total depth of the carriageway foundation shall be 7” for minor roads or 9” for major roads.

81.

Surfacing The Contractor shall supply, lay and roll with a 6-ton roller the two-course wearing surface to true line and levels and to the satisfaction of the Pengarah Kejuruteraan. The surfacing having a total thickness of 3 inches shall as specified consist of two course bitumen or bitumen-rubber macadam produced and supplied by the Council at rates fixed by the Pengarah Kejuruteraan. The base course (2”) shall be 1 ½” nominal size precoated bitumen macadam and the wearing course (1”) shall be either (a)3/4”-1/2” nominal size precoated bitumen or bitumen/rubber macadam as detailed or (b) cold fine asphalt. Before any macadam is laid the foundation shall be well brushed and cleaned to remove dust and loose stones or other deleterious materials. Such material shall be removed from the site at the contractor’s expense and not deposited on the sidetable. Surfacing shall not be carried out during or immediately after rain. The final 1” thick wearing surface of the carriageway shall be laid to suitable falls alongside the kerbing between scupper drains to ensure that the surface water draining from the carriageway is directed to the drains and does not form pools incapable of drainage alongside the kerbing.

Tack Coat Where bituminous premix material is to be laid on an existing tar or bituminous road surface, a tack coat of bituminous emulsion should first be sprayed with an approved machine on to the existing road surface at a uniform rate of 10-15 sq.yds. per gallon so that a 100% cover is obtained. Any collection of the emulsion in minor depressions shall be brushed out to avoid subsequent bleeding through the asphalt surfacing. The coat of this supply of labour and material for the tack coat shall be included in the tender amount and no claim for extras will be entertained.

MISCELLENOUS 84.

Copings Where the existing coping bricks of drains or other structures are to be taken up and re-set they must be removed with the minimum of damage to the arises and relaid in cement mortar to the required line with ¼” joints well flushed with cement mortar.

85.

Guardwalls Guardwalls shall be built in accordance with Clause 67-“Brickwork” – of 9” brickwork in cement mortar to the shapes and sizes shown in the working or standard drawings. They shall be finished with ½” cement rendering as for drain walls and painted two coats in white “Permacem” or other approved cement paint with an approved black bituminous paint dado.

86.

Refuges And Traffic Islands These shall be constructed in accordance with the working or standard drawings and as specified by the Pengarah Kejuruteraan.

87.

Clearing Up On completion All work shall be carried out in a good workmanlike manner with a minimum of damage and disturbance. All damaged and defective work shall be made good on completion, drain inverts shall be swept out, the whole of the work, including sidetables, cleaned of dirt, mortar droppings, surplus and rejected materials. All such materials shall be removed from the site at the contractor’s expense and the work will not be certified as completed until this is done.

88.

Insurance For Maintenance Period The contractor shall at the completion of the works produce for the inspection and approval of the Pengarah Kejuruteraan a 3rd Party Public Liability Insurance Policy for the maintenance period.

The chart shall be modified from time to time as deemed necessary by the Pengarah Kejuruteraan.

5.

Contract Drawings All of Departmental current “Standard Details” Drawings showing standard details of construction of roads, kerbing, drainage and ancillary works and such other drawings pertaining to the works to be carried out under this contract as may be issued by Pengarah Kejuruteraan during the duration of the contract.

6.

Level Datum All levels are based on (a) Survey Department Datum. or (b) Penang City Council Datum or as stated on drawing.

7.

Disposal Of Waste Water All waste water on the site whether from pumping or other operations shall be disposed of in approval surface drainage water-courses, such that ponding does not occur. The contractor shall maintain all such water courses to which the waste water is discharged to the satisfaction of the Pengarah Kejuruteraan and the Health Authorities. All silt deposits shall be cleaned regularly from drains. In this contract waste water does not include sewage or water used for sanitary facilities, separate provisions for which shall be made.

8.

Traffic Arrangements Constructions and excavations must be adequately fenced and guarded at all times for the protection of all persons who use the highway. Particular attention must be paid to the positioning of the barriers. The whole obstructinon or excavation must be completely fenced off, but unnecessary blocking of traffic lanes must not be permitted. Roads should not be used for the necessary storage of materials. M.B.P.P regulations shall be followed.

9.

Arragements And Location Of Signs All traffic signs used in temporary signing must be reflectorised. Where practicable, signs shall be sited where they will receive maximum benefit from street lighting. The warning signs are to be placed on each side of either approach to a working site, one at a distance of 50 yards and the other at a distance of 100 yards i.e. there will be 8 signs in all.

10.

Temporary Warning Lamps Temporary warning lamps shall be used during the hours of darkness in connection with all temporary signs, barriers and other traffic control devices which are to remain in position at night. Lamps shall show a flashing light.

11.

Lighting Of Trenches And Other Obstructions In Or Adjacent To Streets Lighting should be provided in the following manner :(i)

Across the street : Flashing warning lamps shall be set at 4 feet interval with such white lamps in between as needed to show up the hazard.

(ii)

Lighting required down the street shall be as follows :Red flashing lamps every 100 feet with a sufficient number of white lamps to show the obstructions. The number and position of white lamps will depend on the position and strength of the street lamps.

12.

Use Of Traffic Guidance Drums When a portion of the roadway is closed to traffic by the use of barriers, barricades or signs, adequate traffic guidance drums shall be placed on the road so as to guide traffic smoothly from the wide sections to the narrower section in which portion of the roadway has been closed to traffic.

13.

Temporary Traffic Controls It is essential that traffic control at the site be exercised diligently by competent personnel if the need arises. The method of control is :Mannually operated “stop” and “go” signs, this applies at works of short duration, provided that traffic is not dense. Red and green flags should, under no circumstances, be used to supplement the disc. signs.

14.

Plant And Equipment In all cases where traffic is permitted to use the whole or portion of the existing road, all plant items and similar obstructions shall be removed from the road at night. During the day a red flag shall project beyond the extremity of all plant items (other than vehicles) adjacent to the traffic lane. All plants and equipments shall be lit at nightly by means of red light.

15.

Services The contractor shall note the various services such as LLN cables, water main, telecoms cables, and ducts telephone and electric posts, lamps etc. which are in the route of the sewer. While the plan shows these services as recorded, this is by no means exhaustive and the Majlis Bandaraya Pulau Pinang shall not be responsible for their existence or non existence or the existence of service other than those shown.The conractor shall satisfy himself from the authorities concerned as to the existence and position of various services and shall exercise proper care to prevent damaged to them in the course of the work. All expenses for the repair of any services damaged shall be solely the contractor’s responsibility. The contractor shall also carry out site investigation including trial trenches to determine the best possible location for the sewer trench in order to avoid interference with services and this shall be subject to the approval of the Pengarah Kejuruteraan. 44

16.

Backfilling And Compactions All trenches shall be backfilled with approved material only and any excavated materials deemed unfit for backfilling by the Engineer shall be carted away for approved dumps. Backfilling of trenches in roads shall be in sand and done in a proper manner and well compacted to prevent sinking of reinstated road. Reinstatement of roads and repair of sidetables, entrance driveways, kerbs, scuppers, drains etc. must be carried out to the satisfaction of the engineer as and when required by the Engineer.

17.

The contractor shall note that all quantities shown in the Bill of Quantities are approximate only and payment will be made for actual work carried out as directed.

18.

All cover notes for insurance shall be presented to the Department for checking purposes must be accompanied by receipts of payment of the premium and must contain the following signed by the insurance company either in letter form or as notes :“It is deemed that no withstanding any exceptions in the policy to the contrary, this policy will also include Public Liability Cover for the following :(a)

Weakening of support due to excavations and / or vibrations.

(b)

Excavations to whatever depth as necessary as shown in the drawings and / or required by the specifications.

(c)

Use of all and any kind of machinery necessary to perform the works.

(d)

Any other exceptions in the policy which in the sole opinion of the engineer contradicts any of the proposed works or the method of constructing such works”.

The Public Liability Insurance Cover provided by the Contractor shall indemnify the council against all claims for damages, compensation, fines or penalties as stated to the minimum amounts as follows :-

During any one period of Insurance – Unlimited.

Employees Social Security Act 1969 / Workmen’s Compensation Insurance (Vide Clause 45(a) to (d) of the General Conditions of Contract). All employees (five and above in number unless the provision of the Act are made applicable to a lesser number) and whose wages do not exceed RM500/- a month shall be registered under the Employees Social Security Act, 1969, and in case where the number of employees is less than five, shall be covered by Workmen’s Compensation Insurance.

20.

The sequence of work shall be subject to the approval of the Engineer and the contractor shall follow such sequence as the Engineer may from time to time require.

21.

The quantities stated for provisional items may be incresed or decreased as deemed necessary by the Engineer. Work under these items, shall be carried out on the written instructions from the engineer only. Payment will be made at the rate quoted against the item.

22.

No trees are to be felled without the approval of the engineer and the relevant authorities. The contractor shall make all efforts to avoid damaging any trees. Where approval is given to fell any private trees the Majlis shall pay compensation to the owners of fruit trees at the approved rates only.

23.

The Majlis will pay compensation to owners of fruit bearing trees only at approved rates.

24.

Rates for excavation and backfilling are deemed to include the cost of removal of all excess soil, rock etc. and for their disposal of the Engineer’s satisfaction. They shall also include the supply of approved backfill material to make up the original ground level. The backfill material is to be compacted to the satisfaction of the Pengarah Kejuruteraan.

25.

The contractor shall be deemed to have inspected the site and complete alignment and formed his own estimate of the obstructions etc. to be encountered. He shall therefore allow in the rates for the complete repair and reinstatement of all such obstructions affected or damaged during the construction of the sewer eg. drains, culverts, pavements, roads, houses, fencing, retaining walls, flower patch, posts, septic tanks etc. Unless 45

specifically stated in this contract, he shall complete such repair and reinstatement at his own expenses to the satisfaction of the Pengarah Kejuruteraan and the property owner(s). No extra for remedial work other than that mentioned in this contract will be paid. 26.

Contractor shall be liable and shall pay compensation for any damage to LLN cables, telecoms, power lines, water mains, manholes etc.

27.

Excavations in roads shall be done in accordance with MBPP standard requirements and cutting shall be done using diamond cutters.

28.

If a tender is submitted with arithmetical errors, the figures stated in the Form of Tender will be assumed to be the correct figure and the Tenderer must correct the arithmetically incorrect Bill of Quantities to agree with the tender figure.

29.

Contractor to ensure that the construction will not affect the drainage in the area. Smooth flow of drainage to be maintained throughout the whole contract period.

30.

The contractor is entirely responsible for the disposal of all excavated spoil, damaged fencing, etc. No site for dumping will be provided by the Majlis Bandaraya Pulau Pinang.

31.

The conditions of contract, the Specifications and Drawings shall be read in conjunction with the Bill of Quantities.

32.

The method of measurement of the various items of work shall be as described in these documents notwithstanding any local or general customs.

33.

The rates and prices in the Bill of Quantities (comprehensively referred to as the Contracts Rates) shall except in so far as it is otherwise provided be deemed to cover all the Contractor’s and his Sub-Contractor’s if any, obligations under the contract and all matters and things necessary for the proper completion and maintenance of the Works in their entirety.

34.

A rate and/or price is to be entered against each item in the Bill of Quantities whether quantities are stated or not. The cost of any item against which a Contract Rate has not been entered shall be deemed to be covered by other Contract Rates.

35.

Except where expressly shown to the contrary all quantities are nett and no allowance has been made for waste.

36.

The work or material covered by items in the Bill of Quantities are as detailed in the Specification or Drawings.

37.

The rates and prices shall be quoted in Malaysian Ringgit (RM)

38.

Provisional Sums shall be dealt with as provided in the Conditions of Contract.

39.

Certain materials may be provided by the Council at the rates given in the Schedule of Rates. Unless so stated in the Schedule, no material will be supplied by the Council. The rates are, unless specifically stated to the contrary, the rates ex store and the contractor shall be responsible for loading, transporting to site, unloading and any damage, breakage or loss.

40.

Concreting works of more that 4 cubic meters capacity must be of ready mix concrete.

YOUR ATTENTION IS DRAWN TO THE FOLLOWING CLAUSES 41.

Should the contractor fail to commence any job within 3 days of written order/the letter of intent the Pengarah Kejuruteraan shall have the authority to carry out the said works without notice to the contractor and the expense incurred shall be borne by the contractor or deducted from any monies due or to become due to him. This condition shall supersede Clause 21 of the General Conditions of Contract.

42.

The Contractor shall complete all works within the completion date stated in the written order/letter of intent. Failing which, the contractor shall be liable to a fine as per LAD rate for each day the work is not completed there on until the Majlis move in to complete the said works and the expense incurred shall be borne by the contractor or deducted from any monies due or to become due to him.

43.

The Contractor shall bear in mind that strict control will be exercised by the department’s officers on site. The Pengarah or his representative shall have the authority to stop or reject any works which are not carried out according to specification or has failed in the foregoing particulars stated in the General Conditions of Contract, Specification and Addendum Specification.

44.

If the contractor fails to carry out any work after 2 weeks of the final warning letter, the contract will be terminated.

PENGARAH KEJURUTERAAN ADDENDUM TO STANDARD SPECIFICATION PAVIORY 9.1

9.2

GENERAL

SUB-GRADE

-

The Pengarah Kejuruteraan must be notified and his approval obtained before commencing on the paving work.

-

Paving materials shall be 60mm thick interlocking “Monier” concrete block or approved equivalent. Samples shall be deposited with the Pengarah Kejuruteraan free of charge.

-

All stained or damaged or defective blocks shall be rejected.

-

The subgrade shall be formed by boxing out, filling and trimming as necessary to the required formation levels. After boxing out and prior to the placement of fill materials, the full area of the sub-grade shall be compacted and levelled to a depth of 143 mm from the curb top height. Compaction should be carried out using overlapping passes of a vibrating plate compactor which can also be utilised for the subbase and send bedding layers.

9.3

SUB-BASE

-

Sub-Base shall be fine crushed rock of hard durable limestones or other suitable stone. It shall be free from any clay lumps vegetable matter or other deleterious materials. The percentage passing the 0.075 sieve shall not be more than 50% of that passing the 0.425 sieve.

After the prepared subgrade has been approved, fine crushed rock shall be spread in such a way to prevent segregation and compacted in layers not exceeding 53mm.

-

The subbase material should be loosely spread in one layer to the required level and if necessary water added before compaction to reach the desired moisture content. The sand bedding should not be used as this will almost certainly lead to uneven compaction of the sand bedding resulting in an uneven surface in the completed footpath crossing.

9.4

BEDDING SAND

-

Bedding Sand shall be wellgraded sand passing a 4.75 mm sieve. The sand shall be fine of deleterious soluable salts or other contaminants and protected against rain when stockpiled on site prior to spreading to maintain a uniform moisture.

9.5

SPREADING BEDDING SAND

-

The bedding sand shall be spread loose, in a uniform layer. The precise depth shall be determined on site prior to spreading. It shall achieve a uniform thickness of 30 mm + 10 mm (1 3/16” + 3/8”) following final compaction of the pavement.

9.6

SCREEDING OF BEDDING SAND

-

The spread and shall be carefully maintained in a loose condition and protected against precompation both prior to and following screeding. Any precompacted sand or screeded sand left overnight shall be removed and replaced.

9.7

PAVING FINISH

-

Shall be as shown in the drawing.

9.8

LAYING PAVING UNIT

-

Paving units shall be placed on the screeded sand bed to the nominated laying pattern with care being taken to maintain the specified bond throughout the job. Paving units shall be placed with 2 to 4 mm (1/16” to 5/32”) gaps between adjacent unit such that all joints are correctly aligned.

-

Where possible the first row should abut against an edge restraint with a gap of 2 to 4 mm (1/16” to 5/32”) and shall be laid at suitable angle to the edge restraint to

achieve the required visual orientation of paving units in the completed pavement.

9.9

COMPACTION AND FINAL SURFACING TREATMENT

-

In each row all full units shall be laid first. Closure units shall be cut and fitted subsequently. Such closure units shall consist of not less than 25% of a full unit.

-

No pedestrian traffic shall be allowed on the paving prior to mechanical compaction to prevent disturbance of the units.

-

After laying the pacing units, the sand bedding shall be fully compacted and the units brought to design levels and profiles by not less than two passes to a suitable plate compactor. It is imperative to achieve thorough compaction of the sand bedding and to bring the pavement the design profiles before filling joints.

-

The compactor shall be high frequency low amplitude mechnical flat plate vibrator having a plate area sufficient to cover a minimum of 12 units and energy output of about 1 tonne to compact the bedding sand layer.

-

The correct sequence for compaction shall be :-

-

1)

Vibrate pavement down thoroughly.

-

2)

Apply sand and sweep into joints.

-

3)

Vibrate sand into the joints.

-

4)

Final sweep over with a broom.

-

All work to within 1 metre (3’3”) of the laying face must be left fully compacted at the completion of each day’s laying.

9.10

FILLING JOINT SAND

-

The non-staining sand free of all soluable deleterious salts and other contaminants, shall pass a 1.18 mm sieve and have about 10% of the material passing a 75% sieve.

9.11

EXCESS SAND

-

Excess sand shall be removed from the site on completion of section of the work.

9.12

PAVING PATTERN

-

Shall be as shown on drawings or to Engineer’s instructions.

9.13

EDGE RESTRAINTS

-

Adequate edge restraint shall be provided along perimeter of all paving in the form of integral kerbs and gutter, concrete rub of edge strip of in-situ concrete. The face of the edge restraint where it abuts paving unit, shall be vertical down to the sub-base.

-

All edge restraint shall be constructed to dimensions and levels as shown on the drawing and shall be supported on a compacted sub-base not less than 75mm deep.

-

Where paving occurs over existing drains, cement mortar shall be used instead of bedding sand. The contractor shall ensure that the finished level of the paving over the drain and the adjacent paving be the same.

-

Where paving occurs over existing concrete slabs, the contractor shall excavate to the required depth and backfill with the various specified layers.

-

Where small gaps (less than 25mm) need to be filled, use dry sand and cement only.

-

Where instructed the contractor may used a grout mix of 1:3 which shall be brushed into paving joints to discourage any plant growth.

-

A fall of 1:40 shall be provided in the direction as shown in the drawings.

TENDER MENINGGIKAN ARAS JALAN DAN MEMBAIKI BAHU JALAN DI JALAN LUMBA KUDA DAERAH TIMUR LAUT PULAU PINANG. JK(J) /ST(K)/211/18 Jadual ini hendaklah dibaca dengan teliti selaras dengan Syarat-Syarat Am Kontrak Dan Spesifikasi-Spesifikasi (General Conditions Of Contract and Specifications). Kontraktor hendaklah mengenalpasti keseluruhan kerjakerja yang terlibat disetiap tapak dan mengambilkira setiap perkara yang perlu dalam melaksanakan kerja tersebut. Keseluruhan kerja akan diukur setelah siap terlaksana dan dibayar mengikut kuantiti kerja sebenar berdasarkan pada jadual kadarharga. Semua ukuran akan dikira sebagai kuantiti baru kerja itu. KERJA-KERJA PARIT PEMBETUNG KEKOTAK DWF 1200MM X 1050MM (BOX CULVERT) TANPA PENUTUP (LID) Membekal semua bahan, buruh, jentera dan segala peralatan untuk membekal dan memasang pembentung kekotak pra tuang DWF precast box culvert yang mempunyai Lesen Pensijilan Barangan SIRIM berukuran 1200mm x 1050mm tanpa penutup mengikut jajaran dan aras seperti diperincikan di dalam lukisan kontrak JK(J)P13/2018. Kos termasuk meninggi atau menurun tebing parit tidak melebihi 150mm jika perlu, menebuk lubang scupper mengorek, memecah parit sediada dan sebarang struktur dari sebarang jenis bahan mengikut lebar dan kedalaman seperti dalam lukisan kontrak, memasang geotekstil TS20 yang dipotong pada kelebaran 600mm dan dibalut pada setiap sambungan box culvert serta penutup (lid) untuk tepi dan atas, menimbus semula dengan bahan yang diluluskan, menambah dan memadat ke paras yang dikehendaki. Kos adalah termasuk penutup lurang FRP berukuran 900mm x 900mm X 38mm. Lebar dan kedalaman seperti dalam lukisan kontrak, menimbus semula dengan bahan yang diluluskan, menambah dan memadat ke paras yang dikehendaki. Tahap pemadatan hendaklah seperti yang diarahkan oleh Pengarah Kejuruteraan. Kadar juga termasuk membuang bahan-bahan yang tidak dikehendaki ke kawasan yang ditentukan.
